국문 초록

부동산경매절차는 국가의 공권력인 강제집행권을 행사하는 절차이므로 획일적이고 강제적으로 진행되는 것이 원칙이지만, 배당절차는 매각대금을 공평하게 분배하는 절차이므로 채권자들이 배당액에 대하여 합의를 하면 이러한 합의를 존중하는 점에서 그 절차가 민주적이며, 채권자들의 적극적 절차개입이 오히려 존중되어야 한다는 점에서 압류나 매각절차와 다른 특성을 가진다. 배당기일에 배당은 기본 순위배당을 원칙으로 하고, 채권자간의 우선순위의 충돌․저촉이 있는 때에는 특수배당방 법에 의해서 배당을 실시한다. 즉, 안분배당, 안분흡수배당, 안분․순환흡수배당의 방법에 의해 배당을 하는 것이 배당실 무의 일반적 방법이다. 이 논문은 경매대가를 배당함에 있어 배당순위에 따른 배당과 배당순위가 충돌할 경우 경매절차상 이해관계인사이의 이익조정에 관한 학설을 검토하여 배당의 형평성에 관한 연구를 한 것이다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES This paper examines the attitudes of the case law and precedent in the reimbursement stage of the executive court, which is the last stage in the real estate auction procedure, The goal is to present a method with the least distortion. (2) RESEARCH METHOD As a method of research, we chose a philosophical approach to review monographs, papers, and cases at home and abroad. Comparative legal considerations were also made for the necessary parts. Furthermore, we conducted a study on the profit adjustment method when the ranking and ranking of dividends conflict in the real estate auction procedure. (3) RESEARCH FINDINGS Through this study, we conducted a study on the last stage of the auction procedure in the real estate auction procedure and examined the theory of profit adjustment among stake holders in case of a conflict in the ranking of dividends. In discussing how to adjust profits, I found inconsistencies in each theory. 2. RESULTS As a result, in the real estate auction procedure, when the ranking of the payout of a prize conflicts with the rank of the payout, it gets the theory of mortgage that has the least distortion among the theories about how to adjust the dividend profit. These conclusions are based on the fundamental content of the mortgage lien, which is the most important aspect of dividend policy.
