국문 초록

클라우드컴퓨팅(Cloud Computing)이란 집적･공유된 정보통신기기, 정보통신설비, 소프트웨어 등 정보통신자원을 이용자의 요구나 수요 변화에 따라 정보통신망을 통하여 신축적으로 이용할 수 있도록 하는 정보처리체계를 말한다. 이러한 클라우드컴퓨팅 산업은 지난 몇 년간 꾸준한 성장을 이어 왔으며 인공지능(AI), 사물인터넷(IoT), 빅데이터(big data) 등의 미래 신산업에 있어서 그 정보기반으로 활용될 가능성이 높다는 점에서 향후에도 클라우드컴퓨팅 환경의 확산이 예상된다. 하지만 ‘가상화 기술’ 및 ‘분산처리 기술을 특징으로 하는 클라우드컴퓨팅 환경에서 수사기관은 범죄수사상 필요한 전자정보의 압수･수색이 어려울 수 있다. 왜냐하면 데이터가 다양한 장소의 정보통신자원에서 분산되고 복잡한 과정을 거쳐 처리되기 때문에 종래에 예상하지 못했던 ① 원격 수색, ② 영장의 특정성, ③ 피압수자에 대한 협조요구, ④ 형사관할권, ⑤ 기존의 정보수집 법률(형사소송법, 통신비밀보호법, 전기통신사업법 등)과 클라우드컴퓨팅법과의 해석 문제 등이 발생할 수 있기 때문이다. 따라서 본 논문에서는 클라우드컴퓨팅 시스템에 대한 압수수색과 관련하여 발생할 수 있는 다양한 법적 문제점을 도출하고, 해외 유사 입법례를 검토･분석하여 전자정보 압수수색에 관한 법률의 개선방향과 법 해석방향을 제시하였다.

영문 초록

Cloud computing is an information processing system that makes it possible to flexibly use integrated and shared resources for information and communications, such as devices for information and communications, information and communications systems, and software, through information and communications networks in accordance with changes in users’ requirements or demands. Cloud computing has experienced steady growth over the last few years. Furthermore, the growth is expected to increase over the next few years as the development of new technologies like AI(artificial intelligence), IoT(internet of things) and big data etc. However, law enforcement in these cloud computing environments featuring virtualization technology and distributed processing technology will have trouble searching and seizing electronic information. Because the problems of online search, particularity requirement in search and seizure, duty to assist search warrant execution, jurisdiction and the application of information collectionrelated laws can arise in the search and seizure for the cloud computing system. Accordingly, this paper reviewed various issues on the search and seizure for the cloud computing system, including the legal analysis of foreign rules on the search and seizure for electronic information. At the same time, this paper provided institutional improvements and the direction of statutory interpretation on these various issues.
