드론 촬영의 형법적 문제

국문 초록

드론이 사회 전 분야에 걸쳐 급속히 확산되면서 드론 촬영으로 인한 사생활 및 개인정보 침해 문제가 대두되고 있다. 본고에서는 촬영 대상의 동의를 받지 않고 이루어진 ‘드론 무단 촬영’의 형사처벌 가능성을 개인정보 보호법 위반 책임, 위치정보법 위반 책임, 사생활 침해 책임으로 나누어 검토하였다. 검토 결과 현행 법체계상 드론 무단 촬영을 개인정보 보호법 위반으로 처벌하기는 어려우며, 위치정보법상의 개인위치정보수집 위반죄 혹은 형법상의 주거수색죄가 성립할 가능성은 있으나 그 처벌의 타당성에 관하여 상당한 논란이 예상된다. 드론을 규율하는 명확한 법률 조항이나 개별 법률이 없는 현행법제 하에서는 드론 무단 촬영을 형법적으로 규율하기에 한계가 있다. 드론 무단 촬영의 규제 여부, 형사처벌 여부 및 그 처벌의 수준에 관하여 사회적 합의를 거쳐 입법화할 필요가 있다.

영문 초록

‘Drone’ is a common term representing ‘Unmanned Aerial Vehicle’. As the drone spreads rapidly throughout the society, the privacy invasion and personal information intrusion issues from the ‘unconsenting drone filming’ - the filming performed by drone without consent of the target - are rising. This article discusses the possibility of the criminal punishment on the unconsenting drone filming by reviewing the criminal liability of Personal Information Protection Act(hereafter ‘PIPA’), Location Information Protection Act(hereafter ‘LIPA’), and privacy intrusion. This article contends that (ⅰ) the PIPA is hardly applicable to hold the unconsenting drone filming criminally liable and (ⅱ) the penalty of ‘unauthorized collection of personal location information’ on LIPA or ‘illegal search of human habitation or body’ on Criminal Code Act might be applicable to the unconsenting drone filming with considerable controversy over the validity of the punishment. The limitation of penal regulation on the unconsenting drone filming is unevitable under the current legal system without specific article or law regarding drone. The public consensus regarding the possibility of regulating and punishing on the unconsenting drone filming should be established and the drone law should be legislated based on that consensus.
