보험사기 의도와 중화 작용 및 사법부 신뢰 관계

국문 초록

보험은 우리 사회에서 발생하는 다양한 사건·사고·질병 등 예상하지 못하는 상황을 대비하기 위해 만들어진 제도이다. 보험제도는 금전적 급부이고 대상이 특정인이 아닌 점, 형법상의 사기 행위보다 경미하다는 특징이 있어 다양한 위장 등으로 보험사기가 발생하고 있다. 보험사기는 더 이상 방치해서는 안 될 사회적 문제이지만 보험사기 감소와 예방을 위한 연구는 매우 한정적이다. 이 연구에서는 일반인을 대상으로 일정한 시나리오를 제시하여 당사자에게 보험사기 가능성이 있는지를 살펴보았다. 보험사기에는 다양한 유형이 있지만 실제 우리 생활과 밀접한 곳에서 발생 가능하기 때문에 일반인도 보험사기가 가능한데 만일 이에 대한 판단으로서 중화작용을 적용하였다. 또한 보험사기에 대한 사법부의 처벌에 대해 신뢰가 있다면 조절변수로서 관계가 있는지 그리고 보험사기 의도 여부에 따라 중화작용과 사법부의 신뢰에 차이가 있는지를 연구 설계하였다. 연구 결과 중화작용은 보험사기에 영향을 주었지만 사법부의 신뢰는 조절하지는 못하였 다. 또한 보험사기 의도자의 경우 중화작용을 하여 자신을 합리화하지만, 사법부에 대한 차이는 없는 것으로 나타났다. 이 결과는 사법부의 지금까지 보험사 감소와 예방을 위한 정책기저에 다양한 정책적 제안이 필요하다는 것이다. 향 후 다양한 연구 설계를 통해 보험사기 감소와 예방을 위한 정책적 제안이 있어야 한다.

영문 초록

Insurance is a system to prepare for future accidents and is closely related in our lives. However, by utilizing the insurance system, it has been an increase in insurance fraud. As a result, insurance fraud is a serious social problem.(ex: Loss of humanity, mammonism, murder, injury etc). In the first half of 2016 year, Insurance fraud occurred 210 billion dollars. in South Korea. Therefore, various efforts are needed to prevent and reduce insurance fraud. So it requires a variety of research related to insurance fraud. However, in the study of the up to now, it has been very limited. The main objective of this study is the insurance fraud reduction and prevention. More specifically, this study investigated the relationship the intention of the insurance fraud, neutralizing(drift theory) and CJ trust. The independent variable is the neutralization, the dependent variable is the intention of the insurance fraud. And adjusting variables were used to CJ trust. Results are below. First, the neutralization has the effect on the insurance fraud. Second, the neutralization has the effect on the CJ trust. Third, CJ trust did not effect on intention of the insurance fraud. Fourth, between neutralizing and intention of the insurance fraud, Control variable (CJ trust)is not the action. Fifth, neutralizing effect, there was a difference depending on the time of insurance fraud. Sixth, there was no difference intention of the insurance fraud and CJ trust. Limitation of this study was further discussed and a future study with insurance fraud was also suggested.
