국문 초록

우리는 SW가 삶의 가치를 높이거나 문제해결 도구로 사용됨으로써, 기업 및 국가 경쟁력을 제고하는 SW중심사회(SW oriented Society)에 살고 있다. 다양한 산업, 기술간 융합⋅결합을 통해서 시너지 효과를 높이고 있으며, 그 중심에는 SW가 있다. SW는 일상에서 사용되는 기본적인 요소이며, ICT기기의 핵심이기도 하다. SW의 기본법인 소프트웨어산업진흥법은 1986년 제정된 SW개발촉진법을 근원으로 하여, 2000년 전면 개정되었으나 SW진흥 보다는 SI(system integration) 중심의 공공SW사업에 치중되어 있다. SW는 HW 및 IT서비스의 가치를 높이는 역할을 하며 다양한 산업에 소재로써 활용되고 있다. 그러나, 현행 법률은 그 내용에서는 진흥과는 거리가 있어, SW 중심사회에 맞게 소프트웨어산업진흥법의 체계를 재구성할 필요성이 커지고 있다. 본 연구는 SW중심사회 구현을 위해 소프트웨어산업진흥법의 개정방향을 제시하고자 한다. 현행 소프트웨어산업진흥법은 SW산업과 공공SW사업이라는 두 가지 축으로 이루어져있으며, 주로 공공SW사업을 통해 자원 배분 및 관련된 이해관계를 조정 하는 역할비중이 작지 않다. 새로운 SW영역에 대한 대응이 미흡한 면이 있기 때문에 SW서비스, SW플랫폼, 융합 SW, 게임 SW 등 다양한 SW 영역을 포괄하는 입법의 필요성이 커지고 있다. 이를 위해 현행 소프트웨어산업진흥법을 SW진흥체계와 공공SW사업 체계로 분법하는 것을 제안한다. 즉, SW진흥 체계에 관해서는 SW진흥법으로 하며, 공공SW사업 체계에 관해서는 공공SW사업법으로 하는 것이다. 이로써 SW 진흥을 확대시키고, SW규제를 완화함으로써 SW경쟁력을 확보하고, 생태계를 구축할수 있을 것으로 기대된다.

영문 초록

We can live in SW oriented society to enhance enterprise and national competitiveness(SW oriented Society), SW is being used as a troubleshooting tool to increase or the value of life. A variety of industrial, technical, through the coupling between the fusion and increase the synergistic effect, SW has centered. SW is a basic element used in everyday life, it is also the core of the device unit. SW and SW of the Basic Law of the SW Industry Promotion is enacted in 1986. SW Development Promotion Act was enacted in 2000, was revised rather than SW development SI(system integration) is focused on the center of public SW business. SW acts to increase the value of HW and IT services is being used as a material in various industries. There is a need to reorganize the system of SW Industry Promotion is growing to meet the SW oriented society. The purpose of this study is to present a revised direction of the SW Industry Promotion for the SW implementation oriented society. Current SW Industry Promotion consists of two axes of SW industry and public business, not less gravity mainly acts to adjust the allocation of resources and relevant stakeholders through public SW business. Because if this is insufficient response to the new SW, SW service area, SW platform, fusion SW, SW game there is a growing need for such legislation to encompass a broad SW area. The current SW Industry Promotion for this purpose, we propose that the equity method to the SW business promotion system and the public system. That is, with respect to the Promotion is SW promotion system, as for the public system to the public SW Business Act. This broadening the SW promotion, by relaxing the SW regulation securing competitiveness, is expected to be able to build the ecosystem.
