외국인 테러전투원의 실태 및 국제사회의 공조방안

국문 초록

최근 전 세계 각지에서 동시다발적으로 발생하는 테러공격에 대해 UN안전보장이사회는 결의안 제2178호를 발의하여 적극적인 제재에 나서기로 하였다. 자국민이 아닌 외국인이 수니파 무장세력 이슬람국가(IS)와 같은 테러단체에 가입해 활동하지 못하도록 하는 내용을 담고 있다. 주된 내용으로는 외국인 테러전투원의 모집과 조직화 방지, 테러활동경비 조달방지, 자국 영토를 통한 테러리스트들의 이동금지, 테러활동정보 공유 등이 해당한다. UN 결의안은 한국을 포함한 197개 UN회원국에 국제법적인 구속력을 지니며, UN회원국은 외국인 테러전투원 방지를 위한 법안 마련 등의 의무를 이행해야 한다. 그러나 우리 국민이 외국의 테러조직에 가담해도 이를 처벌할 수단이 없는 상황이다. 그리고 외국인 테러전투원들의 급진화 과정을 살펴보면, 결심(Decide), 여정(Travel), 훈련 및 전투(Train and Fight), 리턴(Return), 플롯(Plot) 등 5단계를 거치게 되는데 단계별 적절한 대책을 마련할 필요가 있다. 마지막으로 9.11테러 전후의 외국인 테러전투원 활동상황과 움직임에 대한 사전예방, 국제테러리스트로 활동하는 외국인 전투원 차악, UNSCR 제1267호를 통한 안전보장이사회의 준사법적 역할수립과 지속적인 적용이 필요한 시점이다.

영문 초록

The UN Security Council was a positive initiative the sanctions resolution No. 2178 about the terrorist attacks that occurred in the recent world at the same time. UNSCR may contain information that prevents foreigners to join a terrorist group activities, such as the Sunni militant Islamic State (IS). The main contents are organized by anti-terrorism and recruitment of foreign fighter, counter-finance related terrorism, prohibit the movement of terrorists through its territory, and terrorist activities, including the appropriate information sharing. Also, UNSCR said that international legally binding on the 197 UN member countries, including South Korea, UN member states should fulfill their obligations and legislation for foreign fighter. But, it would be a not means to punish them even if our people are involved in this situation. And the radicalization process of foreign terrorist fighter are as followed: Decide, Travel, Train and Fight, Return, Plot. Therefore, step-by-step, it is necessary to take appropriate measures. Finally, the foreign fighters, UNSCR No. 1267 of the Security Council through the second point arc quasi-legal acts required to establish and continued to apply as a precautionary action, the international terrorist fighter on terrorism activities and movement before and after the September 11 attacks.
