민간조사제도의 도입에 관한 법적 쟁점 논의

국문 초록

오늘날 다양하고 전문화된 범죄에 대한 예방과 진압에 있어서 국가기관의 수사력은 국민의 신체와 재산을 보호하는데 한계가 있다. 이러한 공백을 대체하기 위한 민간조사제도는 국가기관이 보호해줘야 하는 사각지대에서 각종 법정증인의 자료 확인 및 재판관련 서비스제공, 개인 또는 법인에 관한 조사 등 경찰을 비롯한 수사기관이 만족시킬 수 없는 범죄피해의 회복 등을 위한 대체수단으로 출현하였다. 그리고 국민들의 권익 보호에 대한 기대는 시간이 흐를수록 높아지고 있다. 그러나 경찰을 비롯한 수사기관은 급증하는 치안수요에 시기적절하게 대응하지 못하여 국민들의 기본권 보호에 어려움이 가중되고 있는 실정이다. 민간조사제도를 운영하는 과정에서 발생하게 될 불법적인 상황이나 개인의 기본권 침해 우려가 있는 상황에 대비하기 위해서는 사전 예방적 또는 사후 통제적인 제도장치가 함께 마련되어져야 한다. 현재 국회에 계류 중인 법안들의 주요 쟁점과 관련하여 민간조사원의 지휘 및 감독, 타직렬과의 충동이 예상되는 업무범위, 민간조사원의 자격 및 결격사유, 민간조사원의 사회적 책임과 의무 등에 대해서는 정치권의 다툼이 아닌 국민의 권리와 이익을 위한 조정안으로 타협해서 법안을 검토해야만 한다.

영문 초록

Today, national public authority is limited to protecting the physical and property of citizens in the prevention and voltage for a variety of specialized crime. Private Investigation System emerged as a means to replace these spaces and investigate about witnesses and trial-related materials verification service, and conduct research on individuals and corporations. It also Private Investigation System committed to the restoration of crime. And it is expected to protect the rights of citizens are increasing over time. However, law enforcement agencies including the police is a situation that is difficult weighting the protection of fundamental rights when the police failed to respond adequately to growing public demand. Private Investigation System can lead to situations of illegal work performed, may violate the individual's fundamental rights. Therefore, proactive or post-controlled institutions should be provided with the device. The main issues of the bill currently pending in Congress are as follows: Conduct and oversight of the private investigator, other impulses are anticipated scope of the series, qualified private investigator and disqualification shall be discussing the social responsibility and obligation of the private investigator. And Private Investigation System compromise with adjustments for the rights and interests of the people rather than the political fallout should review the bill.
