국문 초록

본 연구는 몽골의 형사사법시스템 개혁에 대하여 설명하고 지난 11년 동안 몽골의 경찰, 법원, 교정기관의 활동현황을 통계분석을 통해 짚어보고자 한다. 분석을 위해 2004년부터 2014년까지의 형사사법 통계자료를 세 기관으로부터 확보하였다. 이 기간 동안 상당한 정도의 법개정과 형사사법제도 개혁을 단행했음에도 불구하고 사법행정에 대한 시민들의 신뢰는 여전히 답보상태에 머무르고 있으며 비판가들은 형사사법시스템의 능력과 공정성에 의문을 제기하고 있는 상황이다. 형사사법 통계자료에 따르면 매년 평균20,973건의 범죄가 경찰에 신고되었고 이 중 평균13,036건 또는 63퍼센트의 사건이 해결되었다. 매년 평균 19,308명의 범죄 용의자들이 경찰조사를 받고 그 중 8,359명 또는 43.9퍼센트의 피고인들이 법원으로부터 유죄판결을 받는 상황이다. 유죄판결 받은 자들의 처벌결과를 보면, 0.2퍼센트가 사형선고, 73.5퍼센트가 교도소수감, 그리고 26.3퍼센트가 기타의 처벌을 받고 있다. 현재 몽골에는6,000명 정도의 범죄자들이 교도소에 수감되어 있는 상황이다. 이런 내용을 중심으로 몽골의 형사사법제도의 바람직한 방향에 대해 논의를 진행하였다.

영문 초록

The objective of this article is to introduce criminal justice reform in Mongolia and its outcome of performance encompassing last 11 years. Data on criminal justice statistics for period between 2004 and 2014 were obtained from three different criminal justice agencies such as police, court and correction services. Despite the passage of significant legal reforms and considerable changes in criminal justice sector operations, especially in the courts and the police service, public trust in the rule of law is still not well established; and critics often question the capacities and fairness of the criminal justice system. Statistics shows that average crime rate per 100,000 persons were 767 during the last 11 years. According to statistics, 20,973 crimes were reported to police and 13,036 or 63.1percent out of the total number were solved. On average, 19,308 persons were investigated as suspects per year and 8359 or 43.9 percent out of that number were ruled as guilty and convicted by the court. As for types of punishment, 0.2 percent was imposed by death penalty, 73.5 percent by imprisonment, and 26.3 percent by other punishments. Currently, over 6,000 inmates are serving in prison in Mongolia.
