영문 초록

This is a study on the Regulatory issues concerning Corruption in Cyberspace. An outline of this study is as follows : Cyberspace or the online world has seen tremendous growth in the past decade, and this has inevitably brought with it a host of new problems. In particular, corruption has also grown in proportion to the expansion of cyberspace, which in turn has been witness to many new forms of corruptions. Policy-makers can use aggressive policies to combat corruption problems in cyberspace. They may also opt to take measures to sanction individual actions in parallel with or in lieu of aggressive policies. It is up to policy-makers to decide on the best methods. This paper stipulates that not only legal codes but also technical codes should be used in regulating corruption in cyberspace, and proposes a Layer Model, which is a regulation system derived from a consideration of the technical codes. According to this model, cyberspace would be divided into a physical layer, a logical layer and a contents layer. It is argued that legal codes should be used in the physical layer and that technical codes should be used in the logical layer, while the contents layer would require the use of both legal and technical codes. Other factor such as social norms, morals and ethics, guide-lines, and positive laws that act to regulate the corruption impulse must be also be recognized as independent functions. Furthermore, there is a need to ensure the independent functions of civil sanction, criminal sanction and administrative sanction. In conclusion, to regulate the corruption in cyberspace effectively, appropriate regulation needs to be decided upon and the independent roles played by of each regulatory methods must also be guaranteed.
