Mass communicator serves as a information provider performing circulation and provision of diverse information, knowledge and experience in large scales for the segmented and divided mass society. This provides the necessary
elements needed to develop one's own decisions for every member of a community as a information receiver that expresses their decisions.
The recipient of information can not but rely on the sources provided by mass communicators to make decisions. That is why a constitutional value order needs to be created to secure the functions of mass communication.
In addition, freedom of information also needs to be protected for the recipient of information. As noted by the german constitutional court, mass communicators have a public responsibility to contribute in the creation of healthy opinions among the members of the community.
Therefore mass communicators have the obligation to deliver objective and true information. It is, however, difficult to find any academic discussions on the "truth" requirement levied on the mass communicators in the korean
jurisprudential field. but studies for that are stagnated at the view of personal benefit and protection of the law.
This study if focused on the meaning of the truth obligation that is constitutionally levied on the mass communicators. At the same time the constitutional basis will be sought in regards to protecting freedom of information for the recipients.
Moreover, a critical analysis will be done on the content and limits of the truth obligation levied by the Broadcasting Act on broadcasters, subjects of mass communication that use frequency resources.
Based on such assessment, a improvement of the current Broadcasting Act will be presented to protect freedom of information for the recipients.
