방화범죄 수사체제의 실태 분석과 개선방안

국문 초록

본 연구는 방화범죄의 의의와 기관별 통계 집계 상의 차이를 알아보고, 현행의 화인조사와 수사제도를 개관한 뒤, 방화범죄 수사의 문제점을 적시하고 이에 대한 개선방안을 제시하기 위한 것이다. 방화의 의의와 발생실태 및 화재조사와 방화수사의 실태를 분석한 결과 방화범죄수사체계를 개선하기 위해서는 화인조사와 방화수사를 둘러싼 여러 가지 환경의 변화를 고려한 후에 문제점을 적시하고 이에 대한 개선방안을 제시할 필요가 있었다. 화재조사와 수사제도상의 환경 변화로는 제조물 책임법의 시행과 변호사 수의 증가, 헌법재판소의 「실화책임에 관한 법률」 헌법 불합치 선고, FTA에 따른 다국적 화재손해보험사의 국내 진출, 공공기관의 행정정보 공개제도, 행정조직의 패러다임의 변화와 같은 점들을 고려할 필요가 있었다. 이런 고려 위에 실태분석을 통하여 제시된 문제점들은 화재조사 시 소방당국과 경찰 간의 공조가 미흡하였고, 공적 영역의 화재조사가 중심이 되어 신뢰성에 문제가 생길 소지가 많았다. 경찰이 연간 5만 여건에 달하는 화재조사를 다하기에는 상당한 무리가 있음을 알 수 있었다. 경찰의 화재조사 연구 및 감정 기능이 미약하며, 수사기록의 전문성 확보에도 미흡함을 보였다. 이에 대한 개선방안으로 일정규모 이상의 화재에 대하여 유관기관 합동조사로 방화화재 조사체계를 확립하고, 공적 영역의 화재조사를 민간화재조사관제의 도입으로 사적 영역의 화재조사도 할 수 있도록 하여 화재조사와 이에 따른 방화수사의 신뢰성을 높일 필요가 있다. 가장 먼저 현장에 도착하여 감식활동을 하는 소방에도 제한적으로 특별사법경찰권을 부여할 필요가 있다는 점을 강조하였다. 또한 연구 및 감정 기능의 강화를 위해서 중립적인 화재감정원의 설립을 주장하였다. 아울러 수사기록의 전문성 확보를 위해 수사요원들의 전문성 향상을 위한 직무교육의 활성화와 화재수사를 연구하는 요원들이 연구회를 만들어 화재관련정보와 지식을 공유할 수 있는 장이 필요하다는 점을 강조하였다.

영문 초록

The purpose of this study is to examine the meaning of arson, the differences of statistical data between institutions, the analysis of actual condition existing in fire examination and arson investigation. After that, this study state problems of arson investigative system and suggest the countermeasures about arson crimes. There are ambient changes in fire examination and arson investigative system, such as enforcement of a product liability law and increase in lawyer, constitutional discordance adjudication of 「Act on Civil Liability for fire caused by negligence」 by constitutional court, entrance of multinational fire property insurance company according to FTA, information disclosure of public institution, changes of administrative organization paradigm etc. The problems that it is presented through the analysis of the actual condition are such as cooperation insufficiency between fire and police authorities, credibility problem as the fire examination of the public sector. It was quite too much for police to do all the fire investigation which reach almost fifty thousands per year. Fire investigation study and appraisal skill of police was weak and lack expertise of records of criminal investigation. The reform measures are as follows: joint investigation by the related institutions, introduction of civil fire examination expert system, authorizing to the special judicial police power for fire authorities who arrive on the scene first, establishing the neutral fire appraisal board to build up the skill of study and appraisal, revitalization of job-training which improve expertise of investigator, making association where they can share fire related information to procure the expertise of investigation records.
