영문 초록

Japan took South Korea to WTO (World Trade Organization) over Fukushima-related fishery products import ban. While Japan claims that the import ban violates the SPS (Sanitary and Phytosanitary Measures) Agreement Art.2. South Korea argues that the ban would be justified based on the SPS Art 5.7. Even though the SPS Agreement respects each member’s sovereignty over sanitary and phytosanitary measures the Agreement put more emphasis on free trade. This study tries to explore how Precautionary Principle of SPS Art 5.7 is applied in ‘EC-GMOs (European Communities—Measures Affecting the Approval and Marketing of Biotech Products)’ case. It concludes that the application of the Precautionary Principle is not ease to prohibit import even though the product has a risk of harming people or the environment. Therefore the Korea-Japan fishery dispute could be disadvantageous to Korea. One of analysis to win in the dispute Korea should try to prove two requirements for Art. 5.7.; relevant scientific information is insufficient, on the basis of available pertinent information.
