국문 초록

공정한 사회란 사회적 약자에게도 상승의 기회가 보장되는 기회균등의 사회요, 사회적으로 억울함과 의분(indignation)이 없는 사회이다. 이를 위해서는 공정성 내지 정의 개념에 대한 반성이 요청된다.분배적 정의는 정의의 비인격적 분배에만 집중하기 때문에 인격과 인간성에 대한 관심은 없다. 사회적 수혜자에 들지 못하는 소외자들이 배려되고 이들의 권익이 끌어올려지기 위해서는 창조적 정의와 변혁적 정의가 요청된다. 공리주의의 약점은 최대다수의 이익을 위한 행동이 개인을 위한 정의를 무시하는 행동을 인가해 주는 데 있다. 롤스정의론의 공헌은"권리가 선보다 우선하다"고 주장하면서 우리 모두를 공정하게 대하는 절차적 정의를 주제화한 점이다. 그러나 그의 절차적 정의론은 정의를 합의하기 위한 과정을 말하는 것으로 무엇이 정의냐 선이냐 하는 것에 대해서는 엄격한 중립성의 관념에 머물고 있다. 샌들에 의하면 서사적 존재로서 우리는 시민의 권리와 의무에 관하여 입장을 취할 때 우리가 속한 공동체 해석에 의존한다. 그러나 공동체적 자아는 보편적인 인간이 누리는 의무와 권리를 잘 설명해 주지 못하고 있다. 이의 보완을 위하여 신학적 차원의 정의 개념이 요청된다. 교회는 사회양심의 보루가 되어 정부와 사회집단들이 권력욕에 집착하여 자기 몫을 주장할 때 이기심을 버리고 공정한 절차를 따르도록 하라고 조정의 역할을 해야 한다. 이를 위해서는 먼저 사회적 차원에서 분배적 정의, 절차적 정의가 시행되어야 한다. 그리고 분배적, 절차적 정의의 한계를 보완하기 위하여 창조적 정의, 회복적 정의로서의 변혁적 정의, 그리고 지구촌적 정의가 요청된다.

영문 초록

Fair society is a society of equal opportunity in which the weak get guarantee the one of going up and a society without regretfulness and indignation. For it a reflection on the concept of justice or fairness. Distributive justice has no concern in the person and humanity due to concentrating on the impersonal distribution of justice. Creative and transforming justice are needed for that the alienated belonging to the social recipients are cared and their rights are upgraded. The disadvantages of utilitarianism consists in legitimizing the act for the justice of the individuals that the act of the goods for the maximum majority disregards. The contribution of the Rawls' theory of justice is to make thematic the procedural justice treating us fairly affirming "right is superior to the good." However, his theory of procedural justice remains in the idea of strict neutrality concerning what is the good or justice. According to Sandel, we depend as narrative being on the interpretation of community we belong to, in case assuming the position of citizen on the right and duty. However, the communal ego can not explain well the right and duty the universal humans enjoy. For the filling such a gap the concept of justice in the theological dimension is needed. Church, becoming the frontier of social conscience, has to carry out the role of control to urge the government and social powers to give up the egoism and to follow the fair procedure. At first the a distribute and procedural justice should be carried out in the social dimension and for the complementing the disadvantages of the distributive and procedural justice a creative, transforming as retributive justice and global justice asked.
