韓國의 金融實名制 20年의 成果와 改善方向

국문 초록

1993년 8월 12일 임시 국무회의 직후 열린 김영삼 대통령의 긴급 기자회견 발표를 통해 금융실명제가 전격 실시됐다. 1982년 '장영자ㆍ이철희 어음사기사건'이라는 대형 금융사건이 터지며 처음으로 ‘금융실명제’가 공식적으로 그 방법이 계속 거론되어 오다 10년 만에 실시된 것이다. 한국의 금융실명제가 도입된 지 올해로 20주년을 맞았지만 차명계좌를 이용한 음성ㆍ불법적인 금융거래가 여전히 문제시되어 그 많은 논의와 시행착오를 거쳐 금융거래의 정상화를 통해 경제정의를 실현하고 나아가 국민경제의 건전한 발전을 도모하기 위해 도입된 금융실명제이지만 지난 20년간 장밋빛 성공만을 이룬 것은 아니다. 박근혜정부가 지하경제 양성화를 강조하고 나설 만큼 여전히 음성ㆍ불로소득이 널리 퍼져 있는 것도 이를 방증하고 있다. 최근에는 정ㆍ재계 인사들의 차명계좌를 이용한 비자금사건이 불거지며 금융실명제법 개정 논란이 다시금 불거지고 있다. 금융실명제가 시행되어 20년 동안 가명ㆍ무기명 거래가 전면 금지됨으로써 불법자금원의 추적이 가능해지고, 그로 인해 거래 투명성이 제고되고 거래가 활성화되어 금융산업 발전에도 크게 기여했다. 그러나 정ㆍ재계 인사들이 차명계좌를 이용, 비자금을 조성하다 금융당국으로부터 적발되는 일이 늘어나자 금융실명제법의 개정이 요구되고 있다. 국회에서는 차명거래의 전면금지와 행형사적 제재를 담은 개정안이 제출됐으며 이를 계기로 차명거래 규제에 관한 논의가 다시금 관심의 대상이 되고 있다. 본 연구에는 추락하고 있는 한국의 국가경쟁력에 대응하기 투명성 제고와 박근혜정부가 지하경제 양성화 정책 구축을 위해 한국의 금융실명제 실시 20년의 성과와 문제점을 분석한 후 향후 금융거래법이 나아가야 할 개선 방향을 제시하고자 한다.

In this study, the fall in response to South Korea's national competitiveness, transparency and Park Geun-hye bisexual government policies to build the underground economy, South Korea's financial performance and the problem of real-name system to perform analysis of 20 years and two to move on the next Financial Improvement Act is proposed .
