창조경제와 지속가능한 경제민주주의의 공법적 고찰

국문 초록

경제민주화(economic democracy)에 관한 입법 논의가 제대로 정리되지 않은 가운데 창조경제(creative economy)가 주창되면서 논란이 확산되고 있다. 창조경제는 박근혜 정부가 주요 국정 방향으로 정한 것 가운데 하나이다. 박근혜 대통령은 취임사에서 '과학기술과 산업이 융합하고 문화와 산업이 융합하고 산업간 벽을 허문 경계선에 창조의 꽃을 피우는 것'으로 창조경제를 정의하고 있다. 창조경제의 목표는 '융합의 터전 위에 새로운 시장, 새로운 일자리를 만드는 것'이라고 한다. 박근혜정부의 정책 목표는 중산층 70%를 재건하여 국민행복시대를 여는 것이다. 경제의 당면 문제를 해결하고, 지속가능한 성장을 위한 새로운 원동력을 찾고자 하는 것과 다름이 없다. 이에 대해서 개념이 모호하다든지 무엇을 어떻게 하겠다는 것인지 잘 모르겠다는 목소리가 잇따르고 있다. 공법학계에서는 아직 논의가 이뤄지지 않고 있다. 이 문제는 한 정부 내지 한 정권에게만 맡기는 일회성 구호로 치부할 수 없는 것이다. 대한민국 경제질서의 기본이 자유와 창의, 구체적으로 창조를 바탕으로 하고 있기 때문이다. 더 나아가 창조경제는 대한민국을 지속가능하게 하며 경제민주화의 주요한 원동력이 된다. 창조경제와 경제민주화의 관계에 관한 헌법학과 행정법학적, 경제학적, 정치학적 검토를 융복합적으로 진행한다. 창조경제를 가로막고 있는 각종 규제 등 입법 환경을 진단한다. 박근혜 정부가 내놓고 있는 창조경제 정책을 세계 입법조류 등과 비교 검토한다. 헌법재판소의 창조경제에 관한 판단을 살피고, 창조경제에 관한 입법 정책적 제안 즉 '창조경제기본법' 제정을 제안하고자 한다. 우리나라의 산업화, 민주화 경험이 궁극적으로 창조경제와 지속가능한 경제민주화의 제도적 틀을 완비하는 방향으로 가야 한다는 점을 고찰하고자 한다. 이를 위해서는 자유시장경제, 창조중심경제, 규제장벽철폐가 이뤄져야 한다. '창조경제기본법'은 총칙, 창조경제계획, 구체적인 실행, 주무 행정부처, 창조경제위원회, 네거티브 시스템, 창조경제교육과 창조적 인재 육성, 경제민주화 실천, 세계적 교류 협력, 벌칙 등의 체계를 갖추는 게 필요하다. 창조경제는 자유민주주의의 근간이다. 산업화, 민주화, 경제민주화, 창조경제의 흐름을 선순환적으로 진행시키며, 품격있는 자유민주주의를 지속적으로 발전시켜 나가야 한다. 이 같은 과정을 통하여 '제2의 한강의 기적'을 이루어야 할 것이다. 창조경제의 지속가능성은 개인과 기업의 자유와 창의의 발현, 창조경제의 성공, 자유ㆍ창의와 평등의 조화를 통한 경제민주화 성숙, 창조경제의 이륙(take off)의 선순환이 전제되어야 한다. 공법적 과제는 이 같은 과정이 순조롭게 진행되도록 제도적 인프라를 구축하고 법철학적 원리를 끊임없이 제공하여야 한다.

영문 초록

While the legislative debating on economic democracy is not fully arranged, creative economy is advocated and dispute is provoked. Creative economy is one of the important national policies which are chosen by Park Geunhye Government. President Park Geunhye defined creative economy in her inaugural address as 'what is fused in scientific technology and industry, and is fused in culture and industry, is that makes flowers of creation be fully blown on the boundary line where the walls between industries are broken.' The goals of creative economy are 'to make new market and new works on the ground of fusion'. Park Geunhye Government's policy object is to rebuild 70% middle class and to open the era of nation's happiness. It is that they try to solve the immediate economic problem and to find new energy for sustainable growth. About creative economy people say that it's concept is vague and that they can not understand the government's true intentions. Public law scholars are not debating about this problem till now. This is not the one time slogan for one government and one political groups who are incumbent. Because Republic of Korea's economic order's base is on the bottom of liberty and original idea, more concretely creativity. More over creative economy will make ROK be able to be sustainable and will be the impetus for economic democracy. I try to study the relationship between creative economy and economic democracy on the view of constitution law and administration law, economics, politics which are fused. And I try to analyze the legislative environment on many regulations which are hindering creative economy. I try to inspect creative economy policies Park Geunhye Government puts forward in comparison with global trends of legislation. I try to scrutinize Constitutional Court's decision on creative economy. I suggest to legislate 'Creative Economy Basic Law'. I study that ROK's experience of industrialization and democratization shall contribute to complete the institution building for creative economy and sustainable economic democracy. For this liberal market economy and creation centred economy, the destruction of regulations are to be realized.
