국문 초록

1991년 기초의회와 광역의회 재출범 이후 지방의회는 제도상ㆍ운영상 문제점을 꾸준히 제기하여 왔다. 본고에서는 대통령소속 지방분권촉진위원회의 지방의회 활성화와 지방선거제도 개혁 추진을 평가해 보았다. 이명박 정부의 지방분권촉진위원회의 지방의회 활성화와 지방선거제도 개선은 자치역량 강화라는 지방분권 기본방향 중 세부 주요과제의 일환으로 추진되었다. 참여정부가 지방의정 기반강화 및 선거제도 개선을 지방분권 기본방향으로 설정하여 추진한 것과 비교하면 일보 후퇴한 것이다. 그러나 지방분권촉진위원회에서는 지방의회 활성화를 위한 7대 과제를 심의ㆍ의결함으로써 제도개선을 제안하였다는 면에서 박근혜정부가 지방의회 활성화에 한 단계 더 기여할 수 있는 기반을 만들었다. 헌법상 기관인 지방의회 구성은 정치제도의 설계들이 지방의회의 성패에 중대한 영향을 미치는 요인으로 작용할 수 있다. 지방의회가 재구성된 지 23년이 되고 있으나 지방정치의 중심부로 활성화되지 못하고 있는 원인을 지방의회 활성화에 직접적 영향을 초래하는 지방선거제도에 있다고 보고 이를 살펴보았다. 특히, 공직선거법에 의한 지방선거제도 개혁 추진과제를 파악하려는 것은 공직선거법의 세부사항들이 지방의회 활성화에 중요하다는 점을 전제로 한다. 공직선거법상 의원정수 산정과 정당공천제는 지방선거제도에 의한 지방의회 구성에 지속적으로 영향을 미치는 하나의 원형으로서 지방의회 활성화를 위한 기본적인 제도라고 할 수 있다. 지방의회 활성화와 지방선거제도 개혁의 추진은 주민중심의 지방자치를 위한 제도설계가 모색되어야 하므로 원칙과 신뢰를 중시하는 박근혜정부의 지방분권 추진과제로 제시하였다.

영문 초록

After the re-start of the basic council and assembly of large region, the local council has been steadily dealing with systematic and operational problems. This study evaluated the local council activation and local election system reformation of the Presidential Commission for Decentralization. The Improvement of local council activation and local election of Presidential Commission for Decentralization of Lee Myung Bak Government was carried out to reinforce local autonomy capacity as a specific task of basic direction. It was retreated from the policy of Participatory Government that promoted local council and local election system as the basic direction of decentralization. However, Presidential Commission for Decentralization proposed 7 major tasks for activating local council and passed it that set foundation of the contribution of local council activation by Park, Keun Hye Government. The structure of local council as a constitutional organization plays an important role in the success of local council by political system designs. 23 years has passed since the re-start of local council but it has not become the center of local politics. This study presumed the cause that lied in the election system that had direct impact of local council activation and examined the local council election system. In particular, the figuring out reformation task of local election system by Public Official Election Act is prerequisite of the significance of local council activation. In Public Official Election Act, the calculation of number of council members and party nomination are a type of archetype continually affecting composition of local council and is a basic system for activation of the local council. The activation of local council and promotion of local election system reformation must be sought to systematic design for resident focused local autonomy, which is why a decentralization promotion task was suggested of Park Keun Hye Government that emphasizes principle and reliability.
