국문 초록

다양성의 가치실현은 교육상ㆍ고용상으로 사회 전반에 걸쳐 중요한 이익을 가져다 줄뿐만 아니라 민주적 시스템을 기능하게 하는 역할을 한다. 이 글은 소수집단우대정책(affirmative action)에 관한 대표적인 미국연방대법원의 판례인 Hopwood v. Texas 사건을 중심으로 텍사스 대학 로스쿨의 입학제도와 관련된 사건을 소재로 다양성의 가치실현을 위하여 소수집단우대정책의 합헌성에 관하여 검토하고 있다. 소수집단우대정책은 현재 인종적으로 불균형적인 경쟁결과는 과거 차별의 폐해에서 나온 불공정한 결과를 의미하는 것으로 보고 이를 시정하기 위해 인종을 의식한 적극적 구제책이 필요하다는 것이다. 이러한 사고방식은 인종별ㆍ그룹별 결과에 착안하여 평등의 실현도를 측정하는 것으로 단순한 기회평등이 아니라 결과평등을 지향하는 것이다. 한편 소수집단우대정책은 개인주의 이념에 저촉되고 인종과 성별을 고려한 우선처우로서의 성격을 가지는 것이므로 그 대상이 아닌 다수 그룹으로부터 역차별이라는 비난을 받고 있다. 소수집단우대정책에 관한 시비는 미국의 국론을 이분하는 중요한 문제가 되고 있으며 동시에 동일한 차별문제로 구제조치를 모색하는 다른 나라의 정책에 큰 영양을 주고 있다. 본고에서는 이 문제를 연구를 위하여 Hopwood v. Texas 사건의 사실의 개요 및 판결요지, 엄격심사기준하에서의 소수집단우대정책의 합헌성, 다양성의 가치와 민주주의, 다양성의 가치론의 전략적 장점 등에 관하여 검토하고 있다.

영문 초록

Affirmative action is a major legal issue in our society today. Many people have many different opinions on the subject today. Some say that it is a moral issue that has nothing to do with the legal system. However others say it is a necessity in order for minorities and woman to catch up to the majorities and males who have suppressed them throughout history. The term affirmative action refers to policies that take race, ethnicity, physical disabilities, military career, sex or a person's parents' social class into consideration in an attempt to promote equal opportunity or increase ethnicity or other forms of diversity. The focus of such policies ranges from employment and education to public contracting and health programs. The impetus towards affirmative action is twofold: to maximize diversity in all levels of society, along with its presumed benefits, and to redress perceived disadvantages due to overt, institutional, or involuntary discrimination. Opponents argue that it promotes reverse discrimination. Affirmative action is also known as reservation in India, positive discrimination in the United Kingdom and employment equity in Canada. In Korea, admission to universities is also determined by the strict entrance exam, which is extremely competitive at the top level. But most of all Korean universities at the top level are adapting some affirmative actions in cases of Chinese ethnic minority, North Korean refugees, etc. in their recruiting new students. Besides, national universities and law schools have been pressed by the Korean government, so now we are trying to meet the governmental goal which is to recruit a proportion of female professors.
