국문 초록

기본권의 보장과 동시에 안전과 질서를 확보하는 것도 헌법적 가치와 근거를 지니는 국가의 책임과 의무이고, 목적이라고 할 수 있으며, 그것은 경찰의 임무에 속한다. 민주적 법치국가에서 법적안정성과 예측가능성의 엄격한 요구는 당연한 것이지만, 한편으로 시민적 자유주의적ㆍ법치국가적 관점에만 안주할 수 없는 경우가 발생하는 것이다. 대표적으로 독일의 경찰법상 개괄조항에 의한 유연한 법해석의 축적 등은 법치주의의 경직성을 극복하기 위한 장치라고 할 수 있다. 본 연구의 주제인 경찰권행사에 있어서 법적근거로서의 개괄조항은 법률유보의 요구를 만족시키면서, 동시에 개인보호 의무를 다하기 위한 하나의 타협적 도구가 될 수 있음을 제시하였다. 자유적 법치국가의 기초는 인간이 인간답게 살 수 있는 조건을 마련하고 유지하는데 있다고 볼 수 있다. 따라서 법치국가에서 법률의 미비 혹은 불비로 인하여 공공의 안녕과 질서를 해하는 상황을 방관하는 것은 절대로 있을 수 없는 일이다. 경찰권은 기본권을 제한하는 본질적 속성으로 한다는 점에서 개괄조항으로 포괄적 경찰권을 수권하는 경우에 국민의 기본권과 관련해서 면밀한 검토를 요하고, 그 적용은 극히 보충적ㆍ제한적으로 이루어져야 할 것이다.

영문 초록

The maintenance of social securities as well as guarantee of the basic rights is regarded as the responsibility and duty of a country and an ultimate goal and the police are in charge of it. In a democratic country, a strict requirement of constitutional stability and predictability is taken for granted. however, there should be a case that can't be content with only the view of civic legalism. Representatively, accumulation of elastic judicial interpretations on the basis of a general clause exercised by the german police is said to be a safety device to overcome stiffness of legalism. The subject of this study suggests that the general clause as a legal background to exercise the police authority can satisfy the requirement of legal reservation and simultaneously be a conciliatory means to protect the rights of an individual. The basic seeking of a democratic country is to create and keep the required conditions for people to live their life as human beings. Therefore, it's an unforgivable situation that the public welfare is harmed by insufficiency and deficiency of the law. Given the police authority on the basis of a general clause, one should remember to look into the details of the clause regarding the basic rights of people and apply it only in a supplementary and restrictive way.
