민주주의의 원리적 의미와 규범내용

국문 초록

오늘날 민주주의는 정치적인 통치형태를 구분하는 근거로 작용할 뿐만 아니라 '좋은 나라'를 상징하는 대명사처럼 사용되고 있다. 우리 헌법은 제1조에 "대한민국은 민주공화국이다"라고 규정하여 규정의 위치상 상징적 의미에 있어서도 민주주의를 최고의 원리로 하고 있다. 이밖에도 헌법 前文에 "불의에 항거한 4.19민주이념을 계승하고, 조국의 민주개혁과 평화적 통일의 사명에 입각하여", 제4조에 "자유민주적 기본질서에 입각한", 제8조 제1항에 "민주적" 제2항에 "민주적 기본질서", 제32조 제2항에 "국가는 근로의 의무의 내용과 조건을 민주주의원칙에 따라 법률로 정한다" 및 제119조 제2항에 "경제주체간의 조화를 통한 경제의 민주화를 위하여"라고 하여 다양하게 규정하고 있다. 우리 헌법에 이와 같이 다향하게 민주주의를 규정하고 있는 것은 민주주의는 공동체 내의 인격체로서의 개개인이 가지는 자유와 권리를 잘 보장해 주는 가치가 되며, 국가구성원으로서의 국민 개개인의 자기결정에 기초하는 정치적 통합질서의 형성 및 정치적 과정으로서의 법적 생활을 가능하게 하는 가장 중요한 헌법의 지도원리가 되고 있기 때문이다. 본 연구에서는 전반부에서는 주로 원리로서의 민주주의에 대하여 기술하였고 후반부의 마지막 단락에 기본권관점에서의 민주주의에 대하여서도 함께 기술하였다. 오늘날 대부분의 현대국가는 민주주의를 실현하는 효율적 방안으로서 대의제원리를 채택하고 있다. 대의제원리하에서는 국민의 의사와 무관한 국가권력의 행사가 다반사로 일어나게 된다. 기본권으로서의 표현의 자유는 직접민주주의 하에서는 주로 결정의 자유로서의 가치를 실현하며 민주주의 규범내용을 확장하게 한다. 헌법을 통하여 국가공동체를 유지ㆍ존속하고 있는 민주주의국가에 있어서의 기본권은 모든 국가권력의 정당성의 원천이 되고 있음은 두말 할 나위가 없다. 따라서 원리로서의 민주주의를 넘어서 기본권관점에서의 민주주의에 대한 논의가 점차 확대될 필요성 있는 것이다.

영문 초록

Today, democracy not only serves as a basis to distinguish forms of political rule, but also has been used as synonymous symbol of 'good country'. Our Constitution in Article 1 prescribes, "Republic of Korea is a democratic republic," by which even in the symbolic meaning of the positional regulatory provisions democracy is defined as the best principle. In addition to this, the preamble of Constitution says "inheriting April Nineteenth Uprising of 1960 against injustice and upholding democratic ideals, and on the basis of the mission of democratic reform and peaceful unification of our homeland," Article 4 says, "based on the basic principles of freedom and democracy," paragraph 1 of Article 8 says, "democratic," and paragraph 2 says "democratic basic order," paragraph 2 of Article 32 says "Nation determine the terms and conditions of the duty to work in accordance with democratic principles by law," and Article 119 paragraph 2 says "for the democratization of the economy through coordination between economic entities." As such there are a variety of regulations related with democracy. Our Constitution thus variously prescribes democracy, because a democracy is the value which guarantees the rights and liberties of individuals as personalities within the community, and at the same time it is the most important guiding principle of the Constitution which makes possible the formation of the political integration order the based on self-determination of the individual of citizens as a member of our country and legal life as a political process. In this study, the first half mainly described the democracy as principles, and democracy from the perspective of fundamental rights were also described at the last paragraph of the second half. Most of today's modern nations have adopted the principle of representative democracy as the effective methods to realize the democracy. Under the representative principle the exercise of state power which is independent of the people's will routinely happens. Freedom of expression as one of fundamental human rights under direct democracy often realize the value of the freedom of decision and expand the contents norms of democracy. It is not necessary to say that fundamental human rights in democratic countries which exist and maintain the national community by the constitution have become a source of legitimacy of power. Thus, beyond the democracy as principles the discussion about the democracy in terms of fundamental human rights is needed to be gradually expanded.
