강력범죄예방을 위한 경찰활동의 쟁점 분석

국문 초록

경찰은 범죄수사만을 전담하고 있는 여타의 형사사법기관과는 달리 범죄의 예방과 진압을 함께 담당하고 있는 조직이다. 이러한 의미에서 행정경찰과 사법경찰의 기능을 구분할 수 있으며, 행정경찰작용의 경우 검사의 지휘가 이루어질 수 없고, 그 국가적 작용에 있어서 편의주의의 원칙이 적용된다는 점에서 사법경찰작용과 구분되어야 한다. 물론 현실의 상황에서는 위험의 방지ㆍ제거와 범죄수사라는 양자의 기능이 중첩되어서 나타날 수 있으며, 이 경우 그 중점이 어디에 있는지에 따라 경찰작용의 성격이 규명되어야 한다. 현재 경찰과 검찰에서는 각기 다른 강력범죄의 개념을 사용하고 있는데, 학술적 관점에서 강력범죄의 개념을 보다 포괄적으로 정의하고 실무적 차원에서 형사정책적 관리가 필요한 특정 강력범죄의 범주를 특정하는 것이 바람직하며, 이 경우 최소한 형사사법기관간의 용어사용의 통일이 유지되어야 할 것이다. 강력범죄예방을 위한 다양한 경찰전략에 있어서 지적될 수 있는 몇가지 문제점으로는 첫째 형식적인 지역사회 경찰활동을 지양하고, 지역에서 소외되기 쉬운 집단들의 참여기회를 제공하여야 한다. 둘째, 범죄예방을 위한 CCTV활용에 있어서 통합관리시스템을 도입하고 수집된 정보의 관리를 보다 엄격히 통제해야 할 것이다. 셋째, 인권침해의 소지가 있는 우범자관리의 법적 근거를 명확히 하고, 법무부에서 시행하고 있는 전자발찌를 통한 범죄자관리제도와의 연계를 검토해야 한다. 넷째, 아직까지 순찰이나 거점근무의 효율성에 관한 체계적인 국내연구가 부족한 상황에서 막연한 경찰인력의 증가나 관서확충만을 주장할 것이 아니라, 순찰과 거점근무의 효율성에 관한 실증적 연구를 통해 보다 효율적인 근무가 수행될 수 있도록 해야 할 것이다. 본 연구에서는 또한 보다 장기적인 관점에서 범죄예방활동을 개선하기 위한 세가지를 제안하고 있는데, 먼저 수사경찰의 인식전환이다. 범죄예방이 생활안전부서 경찰만이 담당하는 업무가 아닌 수사경찰을 비롯하여 모든 경찰관들이 수행해야 할 기본적인 임무임을 주지하고 사후적 범죄진압이나 범인검거보다 범죄예방활동에 주력해야 할 것이다. 또한 국가적 대범죄활동에 있어서 예방적 범죄투쟁의 주체인 경찰과 형사사법 활동의 주재자인 검찰은 대등한 당사자의 입장에서 효율적인 범죄에방과 진압을 위한 파트너 관계를 형성해야 한다. 마지막으로 실효성있는 경찰의 범죄예방을 위해서 구체적인 범죄혐의의 명백성이 입증되지 않는 상황에서도 범죄예방과 위험방지를 위해 필요한 경우, 경찰권을 발동할 수 있도록 법제도의 개선이 추진되어야 할 것이다.

영문 초록

Unlike other criminal judicial agency, the police organization takes charge of the crime prevention and the criminal investigation together. The function of police organization should be divided into two categories, the first is administrative police, and the second is judicial police. This division casts a long shadow to us, because the former finds legal basis from police administrative law, and the latter enforces the criminal procedure law. In case police has to do these duties simultaneously, the character of the police enforcement depends on where the prime purpose is. The major problem in connection with the concept of the so-called violent crime is that police and prosecution use this term differently, even though they have the same duty in term of crime fight and must cooperate in this work. It is desired that the term of the violent crime would be defined comprehensively from academic aspect and the different usage of this term through law enforcement agencies is unified. Germane to police strategies against the violent crime, following advices could be proposed. Firstly, instead of concentrating on superficial community policing, more access to participation in policing should be provided for the residents who feel they are being excluded from the mainstream of society. Secondly, an integrated management system has to be adopted for the effective usage of CCTV for crime prevention and tighter legal controls over the kinds of personal data corporations and governments can collect is required. Thirdly, the legal basis for the surveillance of criminals who are liable to commit crime is established because of its great risk of violation of human rights. Also, it should be considered, that this surveillance is integrated with the electronic tag mandatory for sex offenders. Fourthly, empirical research on the effectiveness of police patrol and police control at the designated point is needed. In view of a long-term perspective, three advices for paradigm shift are proposed. Firstly, the importance of crime prevention, especially for crime investigators should be emphasized. Secondly, sure, it is given, that the police is an assistant organization of prosecution by crime investigation, but in terms of crime fight the police is an evenly balanced partner of prosecution. finally, the improvement of legal system is needed to support more effective police enforcement for crime prevention.
