소년원생의 교정가능성에 대한 소년보호기관 종사자의 인식 연구

국문 초록

이 연구는 소년보호기관의 성공적인 소년보호 업무수행을 위하여 소년보호업무를 담당하는 199명의 공무원들을 대상으로 관련업무에 대한 인식을 경험적으로 조사한 연구이다. 소년보호기관 공무원들의 소년보호업무와 관련해서 소년들의 비행환경에 가장 큰 영향을 미치는 원인을 전체 응답자의 82.4%가 가정의 문제라고 인식하고 있으며 소년보호처우의 역할이 사회방위와 교정교육이 혼합되어 있다고 생각하는 경우가 61.1%에 해당하고 있으며, 소년원생의 교정가능성에 대해서는 완전한 교정에 한계를 느끼고 있는 경우가 69.7%에 해당하고 있는 것으로 나타났다. 또한 수용과 교육과정에 대한 인식 조사에 있어서는 수용과 교육의 기능이 사회방위와 교육기능을 모두 가지고 있는 것으로 생각하는 경우가 전체 응답자의 72.6%에 해당하고 있으며 교정교화의 성과에 대해서는 81.8%가 긍정적으로 평가하고 있다. 이러한 결과들을 바탕으로 청소년 비행의 주된 요인으로 인식되어지고 있는 가정문제 해결을 위한 다양한 대책마련과 더불어, 소년보호업무에 대한 균형적인 회복적 사법의 지향, 교정교화 역할의 강화는 물론, 소년보호교육기관의 특성화교육 내실화 등을 통하여 소년보호 공무원의 인식변화와 더불어 제도적 개선을 동시에 요구하고 있다.

영문 초록

This is an empirical study on the perception of juvenile protection targeting at 199 civil servants in charge of juvenile protection for the successful operation of juvenile protection institutions. Regarding juvenile protection of civil servants at juvenile protection institutions, 82.3% of total respondents perceived that family issues are the most important reasons behind the misconduct environment of the youth, 61.1% understood that the role of youth protection treatment is a mixture of social defense and correction training, and 69.7% felt limitations in complete correction of juvenile reformatory members. Besides, in perception survey on accommodation and training process, 72.6% of total respondents thought that the functions of accommodation and training contain both social defense and training function, and although 81.8% of the respondents thought that practicality- based correction training and expansion of open treatment are the keys for a successful correction training in the future. Based on these results, future juvenile protection calls for the change in perception of related civil servants as well as institutional improvement at the same time through intended balanced restorative justice, strengthening of the correction education role as well as intensification of specialized training, etc.
