자치경찰과 지방정부와의 관계

국문 초록

우리나라는 남북분단으로 인한 국가안보상의 문제와 지방자치단체의 물적ㆍ인적 지원의 결핍 등으로 경찰 창설 이후 국가경찰제도를 유지해 오고 있다. 그러나 1992년 지방의회의 구성에 이어 1995년 6월 27일 지방자치단체장 선거를 통하여 전면적인 지방자치가 시행됨에 따라 지방화시대에 맞는 자치경찰제의 도입 필요성 또한 증대되고 있다. 김대중 대통령의 국민의 정부에서 자치경찰제의 도입이 100대 국정과제로 채택되어 19저년 4월 '자치경찰제 도입시안'이 마련된 바 있다. 노무현 대통령의 참여정부에서도 지방분권 주요과제로 자치경찰제를 선정하여 추진하고 있다. 더구나 지방 분권특별법 제10조 제3항에서 "국가는 지방행정과 치안행정의 연계성을 확보하고 지역특성에 적합한 치안서비스를 제공하기 위하여 자치경찰제도를 도입하여야 한다"고 규정하고 있어 참여정부 하에서는 자치경찰제가 실현될 전망이다. 그런데 자치경찰제 도입과 관련하여 자치경찰과 지방정부와의 관계는 어떻게 설정되어야 하는 지에 대하여 경찰조직과 관리형태(주로 자치경찰의 도입단위), 경찰공무원의 인사, 경찰기관의 재정, 경찰사무의 배분과 관련하여 논의해 보았다. 이 연구에서는 주로 경찰의 정치적 중립성 확보와 지역실정에 적합한 치안행정의 구현을 위해 자치경찰제의 도입시 다음과 같은 점이 고려될 필요가 있음을 지적하였다. 첫째로 실시단위 및 경찰조직은 국무총리 소속 하에 국가경찰위원회와 시ㆍ도에 시ㆍ도 경찰위원회를 설치하고 그 관리 하에 경찰청과 시ㆍ도 경찰청을 설치한다. 둘째로 경찰공무원의 인사는 경찰행정의 전국적인 통일성과 균형성 및 지방자치단체의 자율적인 인사관리권의 확보를 동시에 고려해야 할 것이다. 그 방안으로 시ㆍ도 경찰위원회의 위원 5명 중 3명은 시 도지사가 임명하고, 2명은 시ㆍ도의회의 추천을 받아 시ㆍ도지사가 임명하게 한다. 시ㆍ도 경찰청장은 경찰인사의 전국적인 균형성 확보 차원에서 경찰청장이 당해 시ㆍ도 경찰위원회의 동의를 얻어 제청한 자를 국무총리를 거쳐 대통령이 임명하게 한다. 경찰서장은 시ㆍ도 경찰청장의 제청으로 경찰청장이 임명하게 한다. 그리고 시ㆍ도 경찰의 직원은 모두 지방직으로 하는 것이 타당하나 자치단체의 재정자립도를 감안하여 경정 이하를 지방공무원으로 한다. 셋째로 경찰기관의 재정은 지방세를 근간으로 하되 지방자치단체의 재정자립도를 감안하여 지방경찰재정교부금법을 제정하여 국고 지원의 범위와 수준을 명시해 놓는 것이 바람직하다. 다만, 국가가 자치경찰의 예산을 보조하더라도 지방자치단체의 재정 운영의 자율성을 신장시킬 수 있도록 해야 한다. 넷째로 경찰사무의 배분 및 감독의 경우 시ㆍ도 경찰은 관할구역에서 방범ㆍ교통ㆍ경비ㆍ수사 등 민생치안에 주력하도록 하며, 국가경찰은 시ㆍ도 경찰이 처리하기 어렵거나 부적합한 사무를 처리하게 한다. 그리고 자치경찰사무에 대한 국가의 감독은 경찰목적 달성을 위한 최소한에 그쳐야 하며, 국가위임사무의 경우 합법성과 합목적성에 대한 감독까지 할 수 있게 하되, 자치사무에 대해서는 합법성의 감독만 하게 하여야 한다 끝으로 현재의 자치경찰제에 대한 논의가 어떻게 확정될지 모르나 국민의 충분한 의견수렴절차를 거쳐 경찰의 민주ㆍ봉사성과 능률ㆍ전문성을 잘 조화 시켜 주민이 원하는 방식의 자치경찰제가 도입될 수 있도록 해야 할 것이다.

영문 초록

South Korea has maintained the National Police System since the establishment of the Korean police because of the consideration of national security rising from the separation between South and North Korea and the deficits of human and material resources of the Local government. However, since the beginning of the local self-governing system followed by the organization of Local assembly in 1992 and the election of the governors of the Local autonomous entity on June 27, 1995, the needs for a Local Police System is also increasing. The government of the former President, Kim Dae-jung had chosen the introduction of the Local Police System as one of the hundred government objectives during his term. Then, his government prepared a tentative plan for the introduction of the Local Police System in April, 1999. Also, the government of the President, Roh Moo-hyun is working on the introduction of the Local Police System as core agenda for the decentralization of the authority. Moreover, 3 of Art.10 of the Special Law for the Decentralization of Power regulates that National government has to introduce the Local Police System in order to make sure the close relationship between Local government and the Local police and to provide services which is appropriate to the local characteristics. Therefore, the introduction of the Local Police System is prospected in the President Roh's term. Thus, with relation to the introduction of the Local Police System, this paper has researched about the appropriate relationships between Local police and the Local government from the consideration of the organization and management system of police (mainly about the degree of decentralization of the police), personnel management of police, financial management of police, and deliberation of the police affairs. This research has discussed on the next several points in order to make sure the political neutrality of police and to realize appropriate local police activities. First, about the operation unit and the organization of the Local police, there should be a National Police Committee under the Prime Minister. As a next level, in the provinces and cities, there should be a province or city Police Committee. Under the control of the province or city Police Committee, the province or the city Police Agency should be established. Second, the personnel management of police should consider not only the unity and balance in the nation-wide level of police officers but also the autonomous personnel management of the Local government. As a recommendable mean, among five members of the province and city Police Committee, three members should be appointed by governor or mayor. And two members should be appointed by governor or major with the recommendation of the Local assembly. In the case of province and city Police Chiefs, the President has to appoint them with the recommendation of the Chief of the National Police based on the agreement of the each province and city Police Committee and with the review of the Prime Minister. In the case of chiefs of the police stations, the Chief of the National Police has to appoint them with the recommendation of each province and city Police Committee. Additionally, the status of the local police officers is desirable to be local public service officers in the case of ranks under the police major considering the financial independence of the local government. Third, the financial support of the Local police should come from the Local government desirably. However, according to the financial independence of each local government, the central government has to support the deficits by establishing the System for the financial support of the police. Even though the central government supports a local government financially, the management of the financial affair should be done autonomously.
