경찰 수사절차상 범죄피해자 정책의 문제점과 개선방안

국문 초록

경찰단계는 범죄피해자가 사법기관을 처음으로 대면하는 첫 관문에 해당하고 범죄피해자의 정신적ㆍ육체적 충격이 가장 큰 시점이므로 범죄피해자보호에 있어 경찰의 역할은 중요하다고 할 수 있다. 따라서 범죄피해자보호를 위한 경찰활동을 통해서 피해자의 신뢰를 얻고 수사목적 달성에도 기여할 수 있으며 궁극적으로는 경찰의 범죄대응능력도 강화되는 효과를 거둘 수가 있는 것이다. 그러나 아직까지도 범죄사건과 관련하여 피해자에 대한 인식과 이해가 부족하고 그에 따라 경찰에 대한 이미지와 신뢰에도 부정적인 영향을 미치고 있는 사례가 빈번하고 있는 것도 사실이다. 따라서 경찰은 범죄현장에서 범죄의 충격을 받은 피해자를 처음으로 만나서 신속하고 효율적인 초동조치를 수행하여 예상하지 못한 범죄에 놀란 피해자에게 안정감을 주어 경찰이 피해자의 기대에 부응하는 조치를 취할 수 있는 제도적 장치를 마련하여야 한다. 이러한 점들에 착안하여 이 연구에서는 경찰이 현재 범죄피해자보호를 위해 시행하고 있는 수사과정상의 절차와 현황에 대해 살펴보고 현재 시행되고 있는 범죄피해자보호를 위한 수사절차상의 경찰활동의 문제점으로 피해자보호시스템 운영상의 문제점, 사건처리 과정에서의 사건정보 고지의 문제점, 피해자 정보보호 및 변호인 선임 등에 관한 문제점 등을 도출하고 이에 따른 개선방안을 제시함으로써 향후 수사단계에서의 범죄피해자 보호 정책을 활성화시키는데 그 목적이 있다.

영문 초록

In contemporary society, elements that threaten the safe lives of people increase as lifestyles of individuals and groups change. The damage caused by, crime is increasing. Therefore, the police have the duty to guarantee freedom and the rights of people. As the national organization which contacts crime victims most closely and often, police also have the responsibility to protect and support crime victims. Therefore, the police can be held more accountable for the security and support of crime victims than other organizations related with protection and support of victims. Nonetheless, the police have focused on retributive jurisdiction trying to break cases by arresting criminals rather than protecting and supporting crime victims. The results have not met expectations. Thus, this study considers background, importance, limitations, legal basis, rights in the criminal procedure, and cases of main developed countries on protection and support of crime victims to conduct reality analysis of the problems of the protection and support system of crime victims as treated by the Korean police. Improvement plans on the protection and support system of crime victims coping with the analyzed problems are proposed Furthermore, by strengthening connected activities through mutual aid system with private organizations like hospitals, counseling organizations, security facilities, and so on, in order that crime victims can forget pains fast and stand firm again as social members looking for new hopes, diverse material and psychological support activities are needed. Above all, stable securement of finances for material support of crime victims as well as construction of these institutional protection and support systems are especially important.
