헌법상 경제질서와 의료체계

국문 초록

의료시장에 있어 경제적 자유와 국가 개입의 필요성 및 그 한계의 설정 등은 헌법적 해명이 필요한 과제들이다. 이 논문에서는 위 과제에 대한 하나의 접근방법으로서 특히 헌법상 경제질서의 관점에서 의료체계의 유형론을 검토한다. 우리 헌법은 혼합적ㆍ개방적 경제질서를 예정하고 있다. 즉, 자본주의 시장경제질서와 사회주의 중앙계획경제질서라는 이념형으로서의 양 극단의 경제질서를 배제하는 의미에서 혼합적 경제질서를, 이러한 양 극단을 배제하되 특정한 경제정책의 결정은 민주적 정치과정에 유보하고 있다는 의미에서 개방적 경제질서를 채택하고 있는 것이다. 이와 같은 경제질서론의 논의는 의료체계론에 있어서도 기본적 궤(軌)를 같이 한다. 즉, 우리 헌법상의 경제질서 하에서 사회주의ㆍ중앙계획형 의료체계는 사적 소유와 직업의 자유 등을 인정하지 않는다는 점에서 고려될 수 없는 의료체계이며, 의료서비스의 특성에 따른 시장실패의 개연성과 건강 및 의료접근성이 가지고 있는 헌법적 가치를 고려할 때 자유기업ㆍ방임형 의료체계 또한 우리 헌법상 경제질서와 충실하게 조화를 이루고 있다고 볼 수는 없다. 영국 NHS와 같은 보편주의ㆍ포괄형 의료체계으로의 전환 역시 규범적인 관점에서나 현실적인 관점에서 적합한 대안은 될 수 없다. 결론적으로 복지지향형 의료체계는 적어도 거시적 관점에서는 헌법상 경제질서와 가장 잘 조화를 이룰 수 있는 의료체계라고 생각한다. 그러나 현재의 국민건강보험법 구조는 의료에 대한 국가의 광범위한 통제를 전제하고 있으며, 그로 인하여 의료의 자율성이 몰각될 위험성이 크다는 점에서 미시적 차원에서는 그 정당성에 의문이 있다. 이는 의료의 자율성을 보다 확대시키는 방향으로의 법정책이 진지하게 모색될 필요가 있음을 시사한다.

영문 초록

This article attempts to analyze the relationship between the economic order and health care system in constitutional law. Economic freedom is the essential factor of the capitalism. However, it has been confronted with critical challenges with the change of the society and the advent of the constitutional basis concerning the welfare state and economic democratization. The economic order in the Constitution of Korea is based on the mixed and open economic system. It means that our economic order excludes a extreme laissez-faire economy or centrally planed economy, and the determination of the specific economic policy should be depended on a democratic political process. This is also true to the health care system and medical service market. The socialist and centrally planned health care system is not permitted under our constitutional economy order. The entrepreneurial and permissible health care system also is not harmony with the Constitution of Korea. This is because there are the possibility of market failure and dissymmetry of health care access in medical service market. The transformation to universal and comprehensive health care system, such as the National Health Service in England, might not be an appropriate alternative from a normative and realistic point of view. In conclusion, welfare-oriented health care system is in harmony with our economic order at least on a macroscopic level. However, the state has extensive power to control medical care under the current legal structure of the National Health Insurance Act of Korea. It requests that the autonomy of medicine should be strengthened in medical law and policy.
