국문 초록

트럭운전자의 중대법규위반으로 인한 트럭사고의 심각성은 이미 트럭운송업계의 쟁점이 되어 왔다. 음주운전, 중앙선 침범, 횡단보도 침범 등 정부에서 규정한 중대법규 위반에 따른 사고의 심각성과 대형사고화는 필연적인 것이며 따라서 근본적인 보완책과 원인규명을 실시할 필요가 있다. 그러나 물류 및 무역업계는 이 사안을 중대한 물류문제의 하나로 채택하지 않으면서 관련 연구의 축적 및 탐구에 비교적 소홀한 입장을 보여 왔다. 그렇지 않아도 화물운송업계의 어려움이 심각한 상황에서 중대법규 위반원인 등 화물사고에 대한 기초적인 분석 및 대책마련마저 소홀하다면 모든 물류활동의 기본 단위인 도로화물분야의 성장도 지연될 수 있음을 상기해야 할 것이다. 본 연구는 도로화물운송에 있어서 화물운전자의 중대법규위반이 보험금 지급에 미치는 영향을 실증적으로 분석, 제시함으로써 도로화물운송사고의 감소 및 개선에 기여하고자 한다.

영문 초록

In Korea's logistics industry, inland transport, especially cargo delivery through the use of roads, accounts for a very high rate compared to any other mode of transportation. This is due to Korea's geographical conditions, which make it difficult for the use of railroads and water transportation. The main purpose of this paper is to analyze how serious traffic violations of truckers can affect the compensation payments by insurance companies for personal damages. We closely investigated the difference of insurance payments between the vehicles that violated serious traffic laws and the vehicles that did not. We built our study on the basis of personal damages from 2008 to 2012 among the cargo vehicles that joined the Korea Trucking Association (KTA) in Busan. The relationship between serious traffic violations and insurance payments (medical payments, mutual agreement payments, and total payments) is clearly established through this study. A constant, persistent, socially acceptable education and promotion on this issue by the insurance industry would have important effects on the reduction of road freight accidents.
