국문 초록

1993년 생물다양성협약이 발효된 이후, 세계 각국은 생명자원의 중요성을 인식하게 되었으며, 이에 따라 무한한 개발 잠재력을 보유하고 있는 해양생명자원을 포함한 생명자원의 확보에 심혈을 기울이고 있다. 해양 생명자원의 확보를 위한 이러한 노력은 국내에서도 시도되고 있는데, 그 예로 국토해양부와 농림수산식품부는 올해 각각 해양생명자원과 관련된 새로운 법안을 발의하였다. 하지만, 이 법안들은 상당부분 중복되는 내용을 포함하고 있다. 그 이유는 해양환경 관리에 대한 업무분장이 제대로 이루어지지 않았기 때문이다. 따라서 해양생명자원의 보호와 효율적인 관리를 위해 현행법을 개정하거나 새로운 법률의 제정이 요구되고 있는 상황이다. 동시에, 해양생명자원을 포함한 해양환경 관리의 일원화를 위한 노력도 이루어져야 할 것이다.

영문 초록

The importance of marine bio-resources was well known to the world at present. With the effectuation of the Convention on Biological Diversity in 1993, States are focusing their effort on acquiring the bio-resources, especially the marine bio-resources which have a vast potential for development. These efforts for the marine bio-resources are attempting in Korea. The Ministry of Land, Transport and Maritime affairs and the Ministry for Food, Agriculture, Forestry and Fisheries moved new laws about marine bio-resources in this year respectively. However, there's a huge overlap between these laws. It is because of uncertain proper division of the authority for the management of marine environment. For a conservation and an effective management of marine bio-resources, we should make an attempt to modify the related laws and regulations, or to enact new one. At the same time, the effort for the unification of management of marine environment including marine bio-resources is required.
