국문 초록

이 논문은 해사노동협약을 비준하기 위하여 2009년 11월에 국회에 제출되어 있는 선원법 개정안 제79조에 따라 국토해양부장관에게 위임된 선내 안전ㆍ보건 및 사고예방 기준을 검토ㆍ제시하기 위한 목적으로 연구되었다. 선박에서의 선원재해율은 육상대비 약 7.4배로 상당히 높은 것으로 나타나선내 안전ㆍ보건과 관련한 사고율이 우려되는 수준이며, 특히 어선에서의 인명사고는 심각한 수준이다. 선내 안전ㆍ보건을 위한 제도로서 선원법, 선원의 안전 및 위생에 관한 규칙, 국제안전관리코드 등에서 일정한 내용을 규정하고 있으나, 미흡한 점이 많아 사고율을 감소시키기 위해서는 대폭적인 규정의 정비가 필요하다. 설문분석에서 보는 바와 같이 관리상태가 양호한 대형 선사는 선내 안전 및 보건을 위한 제도를 마련 수행하고 있으나, 영세한 선사 및 연근해 운항중인 어선의 경우 안전 및 보건을 위한 제도가 마련되어 있지 않아 높은 사고율의 원인이 되고 있다. 따라서 현행 관련 법제도를 보완하고 선박소유자와 선원이 이를 준수하도록 함으로써 선내 안전 보건을 증진해 나갈 필요성이 절실하다고 할 수 있다. 이를 위하여 정부는 선내 안전ㆍ보건기준(시안)을 국토해양부장관 고시로 제정하여야 하고, 선박소유자는 선내 안전ㆍ보건수칙을 제정 및 보급하는 등 선내 안전ㆍ보건기준에서 요구하는 각종 요구사항을 적시에 이행할 수 있도록 대비해 나가야 할 것이다.

영문 초록

This paper intends to study and propose the standards on the safety, health and accident prevention on aboard as delegated to the Minister of Land, Transport and Maritime Affaires by the article 79 of the Seafarers' Act which was proposed in November 2009 by the Korean Government to the National Assembly in order to be able to ratify the Maritime Labour Convention, 2006. The seafarer's accident rate on board was revealed 7.4 times as high as those of on shore accident and the accident rate in relation to the safety and health on board has assumed a very serious dimension and the level of personal accident rate on board fishing vessels is particularly serious. It is true that the Seafarers' Act, the rules on seafarers' safety and health, the international safety management code, etc. provide a certain amount of relevant provisons. However they are not enough to resolve the problem of high rate of seafarers' accident rate so that a comprehensive revision on the standards regarding the seafarer's safety and health needs to be made. As can be seen from the analyses of questionnaire, big shipping companies with good management system usually have well established the safety and health system on board, however small size shipping companies as well as fishing vessels engaged in near coastal areas do not have the safety and health system on board in place which is one of contributable factors to high accident rates. Thus, it is essential to promote and enhance the safety and health system on board through supplementing the existing legal system and requiring shipowners and seafarers to comply with it. To do this the Government must legislate the ministerial notices on the safety and health on board ships and shipowners should establish and implement the safety and health practices in order to implement timely the shipboard safety and health standards.
