우리나라 유류오염손해보상기금 설치를 위한 기초연구

국문 초록

그 동안 유류오염사고에 대한 손해는 1992년 민사책임협약(92 CLC) 및 기금협약(92 FC)에 의한 국제협약체제에 따라 보상이 실행되어 왔다. 지금까지 1992년 민사책임협약과 기금협약체제는 성공적으로 운영되어 왔다고 평가되고 있다. 우리나라도 이들 협약을 수용한 유류오염손해배상보장법 제정을 통해 유류오염손해에 대한 배상 및 보상체제를 구축해 왔다. 유류오염손해 배상 및 보상을 위한 국제협약이 추구하는 것은 피해자에 대한 신속하고 충분한 배상 및 보상이다. 그러나 국제협약체제는 피해보상 처리에 장기간이 걸려서 신속하고 충분한 보상에 효율적으로 대처하지 못하고 있다. 한국은 2003년 추가기금협약에 가입하여 보상한도액은 높아졌으나 신속한 보상에는 도움이 되지 못한다. 이러한 여건에서 이 연구는 신속한 유류오염손해 보상을 위한 국내기금 설치방안을 제시하였다.

영문 초록

This article studied on the effectiveness of Korea's domestic compensation scheme in relation with the international compensation Fund for the damage caused by oil pollution. Oil pollution damage is compensated by the Oil Pollution Compensation Guarantee Act which was enacted in 1993 to comply with international conventions, the 1992 Civil Liability Convention and 1992 Fund Convention. The Oil Pollution Compensation Guarantee Act was amended according to the '2003 Supplementary Fund Convention' which leveled up the extent of liability to be paid by the Fund. The Act is found to be effective for compensation of oil pollution in Korea in terms of extent of liability. However it still reveals a retarded compensation for victims of damage. Based on the study, the article suggested a need for the establishment of the Domestic Fund to guarantee a quick compensation.
