국제법상 PSI 실행의 정당성 확보와 한국의 대응방안에 관한 연구

국문 초록

대량살상무기의 불법적인 확산방지를 위해서 2003년 5월 31일 폴란드 크라코우에서 부시 미국 대통령의 제창으로 출범된 PSI는 현재 한국을 포함하여 95개국이 참여하고 있다. 그러나 국제사회는 PSI를 실행함에 있어서 전통국제법 원칙으로 확립되어 있는 무해통항권과 공해자유의 원칙의 침해 가능성을 문제점으로 지적하고 있다. 이에 미국을 비롯한 PSI 참여국들은 유엔안보리결의 채택, SUA협약의 개정, 그리고 주요 편의치적국과의 양자협정 체결 등의 다양한 방법으로 PSI 실행의 정당성 확보를 위해 지속적인 노력을 하고 있지만, 여전히 PSI 실행의 정당성에 대한 논란이 제기되고 있는 것이 현실이다. 따라서 이 논문에서는 PSI의 전반적인 개념과 그 실행상의 국제법적 문제점을 검토한 다음, 국제법상 PSI 실행의 정당성 확보 방안을 제시한다. 또한 한국의 PSI 정식참여의 의미를 분석한 후 효과적인 PSI 실행을 위한 대응방안을 제시한다.

영문 초록

PSI launched in Krakow, Poland on May 31, 2003 so as to prevent illegal proliferation of weapons of mass destruction from the advocacy of Bush, president of America and 95 countries including South Korea are now participating in PSI. However, regarding the implementation of PSI, the international society points out the problem that PSI has the possibility to infringe the Right of Innocent Passage and the Principle of Freedom of the High Seas. In this connection, the participants in PSI including America put their consistent efforts to secure legitimacy of PSI implementation in various ways of the resolution adoption of the UN Security Council, revision of SUA Convention and conclusion of bilateral agreements between main flags of convenience countries but it is the current situation that there is still argument about legitimacy of PSI implementation. Accordingly, this study reviews the general notions of PSI and the problems with its practice in the aspect of the international law and suggests a plan of securing legitimacy for PSI implementation in the internal law. In addition, after analysis of the meanings of Korean PSI formal participation, countermeasures for efficient PSI implementation will be suggested.
