'자율성 존중 원칙'의 한계에 대한 윤리학적 고찰

국문 초록

자율성 존중 원칙은 생명의료분야의 윤리 원칙 중의 하나로 현재 다른 원칙들에 비해 큰 영향력을 갖고 있으며, 칸트의 윤리학과 공리주의 윤리학을 근거로 하여 '인간의 기본적인 이익을 실현하기 위해 자율성이 존중되어야 한다'는 의미를 담고 있다. 그러나 현대 문화의 근대성으로부터 영향을 받은 이 철학 사조들은 자유와 자율의 본질적인 의미를 왜곡하였으며 인간의 인격을 가치론적으로 평가한다. 인간의 자유는 내적인 필연성으로부터의 자유를 통해 그 본질이 구성되며 인간이 유한하고 상대적인 존재이기 때문에 완전히 절대적일 수 없다. 자유의 참된 의미는 인간에게 주어져 있는 윤리규범 안에서 선을 추구하는 것이며, 따라서 자유와 윤리는 불가분의 관계에 있다. 그러나 자유를 절대적인 것으로 격상시킨 근대 철학 이후의 사조들로 인해 자유는 모든 가치의 원천이 되었으며 이로 인해 양심과 윤리 규범의 개념이 변하고 진리가 왜곡되었다. 인간 본성과 존재에 대한 근본적인 탐구가 결여된 채 합리적인 이성 외의 모든 것이 의미를 가질 수 없게 되었기 때문이다. 자연법은 자유의 본래 의미를 실현할 수 있는 윤리규범으로서 그 근거를 선을 행하려는 인간 본성에 둔다. 또한 신적 본성을 추구하여 윤리적 자율성의 올바른 의미를 찾을 수 있게 하며 모든 인간 존재에게 보편적인 윤리규범으로 작용할 수 있는 도덕법이기 때문에 자율성 존중 원칙의 기초가 되어야 한다. 칸트 윤리학은 비현실적인 독립성을 강조한 자율 개념을 통해 자유를 절대화하였고 합리적인 사고에 근거하는 인간 이성을 통해 인간 스스로 도덕 법칙을 부과하도록 하였다. 인간의 본질을 왜곡한 이 윤리학과 존엄성을 인간의 속성으로 규정한 공리주의가 결합되면서 자율성의 의미가 확대되었다. 현대 사회의 인간 생명은 확대 해석된 자율성 존중 원칙에 의해 존엄성을 위협받고 있으며 이는 안락사와 자살 등의 현상으로 나타나고 있다. 이렇게 무분별하게 확대된 자율성 존중 원칙의 한계는 모든 사람에게 보편적이며 본성적인 자연법을 전제로 고찰하여 판단할 수 있을 것이다. 또한 자유와 자율성, 인간의 본질에 대한 고찰 역시 여기에 기준을 두어야 할 것이다.

영문 초록

Principle of respect for autonomy, one of the principles of biomedical ethics has much influence than any other principles. It means 'autonomy must be respected to realize of human being's basic profits' and based on ethics of Kant and Utilitarianism. But these two philosophical thoughts were influenced by modernity that stress the individual reason, distorting nature meaning of freedom and autonomy, and judge personality by the theory of value. Freedom of human beings consists its nature 'through the inner freedom from the inevitability(libertas a necessitate)' and it can not be completely absolute because human beings are finite and relative existence. The true meaning of freedom is seeking good in moral principle norm that given to human beings, therefore the relationship between freedom and ethics are inseparable. But freedom became the absolute value by modern philosophies therewith concept of conscience and moral principle norm changed and truth was distorted. Because everything in addition to resonable reason could not have meaning with fundamental quest about human nature and existence is lacked. The Nature Law puts the basis in human nature to behave goodness as moral principle norm that can realize meaning originally of freedom. It must become basis of principle of respect for autonomy because it can look for right meaning of ethical autonomy seeking that is divine nature, and it is moral law the can act by moral principle norm that is universal to all human beings. Kantian ethics absolutized freedom through autonomy concept that emphasize unreal independence and did to impose morality rule by human through reason who is based in resonable thought. Meaning of autonomy was expanded as Kantian ethics that distorted essence of human and utilitarianism are combined. Human life of modern society is threatened dignity by expanded analysis of principle of respect for autonomy and it is being expose in actuality phenomenon for example, euthanasia and suicide, and so on. We may define the boundary of principle of respect for autonomy by looking through the Nature Law that universal and the origin nature for human beings. Also Nature Law have to become a standard of judgement on freedom, autonomy and intrinsic attribute of human beings.
