국문 초록

2010년 '범죄피해자보호법'이 개정되어 체계적으로 시행됨에 따라 국가사회적인 범죄피해자 보호 및 지원 제도가 정착되어 가고 있다. 그러나, 군의 범죄피해자들은 폐쇄적이고 위계적인 군 문화 안에서 피해사실을 알리거나 권리구제를 요청함에 있어서 군내 자체 시스템으로서는 범죄피해에 대한 보호 및 지원에 많은 어려움을 느끼고 있으며, 현재 어떠한 제도나 지원활동을 할 수 있는 시스템도 구축되어 있지 않다. 군에서 각종 사건사고가 발생하면 범죄를 저지른 사고자뿐만 아니라 주변동료들에게 신체적ㆍ정신적 직접ㆍ간접피해가 발생하게 되는데, 군에서는 각종 사고(범죄) 발생 시 사고원인 수사와 사고자 처벌, 지휘계통의 지휘책임 추궁 등의 수순으로 후속조치를 할뿐 피해자를 보호하는 노력과 체계 구축이 미흡하다. 이러한 환경에서 군범죄피해자들은 자신이 범죄피해자임을 공론화하는 것보다는 차라리 스스로 범죄피해 사실을 수용해 버림으로써 조직의 질서에 순응하거나 편입되고 있어 또 다른 2차, 3차 범죄피해 발생의 두려움을 가지게 된다. 비록 군도 장병들의 안전과 생명을 중시하는 병영정책을 추진하여 대군 신뢰증진과 선진강군을 육성하기 위해 다양한 제도적 장치를 통해 노력하고 있으나, 이제는 군에서도 범죄피해자를 보호 및 지원할 수 있는 법규를 제정하고 민간피해자지원 단체와 긴밀한 협조체제를 구축하는 등 제반 노력을 기울일 때가 되었다.

영문 초록

Following the reformation and systematical implementation of the 'Crime Victim Protection Act' in 2010, the system of protection and support for victims is being established on both national and social levels. However, crime victims in the military find much difficulty in receiving protection and support from the military especially in requesting protection of rights or reporting the crime due to a closed off, hierarchical culture that is firmly rooted in the military. Moreover, there aren't any established systems to offer support or help. In the various cases of crimes in the military, the victim is not only victimized by the criminal, but also receives both physical and psychological damage directly and indirectly from fellow comrades. Yet, when a crime is committed in the military, the military's follow up measures only include a sequence of investigating the cause, punishing the criminal, and interrogating for the command responsibility, lacking a system to protect the victims and efforts to support it. Being pressured by circumstances to accept the fact of crime rather than to publicize that they are crime victims and risk persecution, the victims of crime end up fearing that they will be victim to other crimes because they conform with and become a part of the military system. Although various methods have been tried to promote trust and nurture elite forces in the military by pursuing military service policies that are centered on the safety of military personnel, there needs to be an all-out effort to protect crime victims in the military by establishing regulations protecting and supporting crime victims and establishing mutual cooperation with the civilian crime victim support centers.
