교도소에 수감된 성폭력 범죄자의 범죄인식과정에 대한 질적사례연구

국문 초록

본 연구는 성폭력 범죄자들의 인식과정을 탐색해 봄으로써 효과적인 치료 프로그램을 제공하여 재범발생을 낮추기 위한 실천적 근거자료를 구축하는 것이 목적이다. 이에 성폭력 범죄로 기소되어 교도소에 수감 중인 범죄자 중 연구목적에 동의한 자 7명을 대상으로 심층인터뷰를 하였고 질적연구방법 중에서도 질적사례연구방법으로 분석하였다. 분석결과 총 40개의 하위범주와 15개의 범주가 구성되었다. 이 범주들을 분석한 결과 성범죄자들은 성장 초기 대부분 가족해체를 경험하였고 피해의식을 갖고 있는 것으로 나타났다. 교도소 수감 동안 참여자들은 성폭력 충동을 통제할 수 있는 치료 프로그램을 받기를 원했다. 이들은 피해자에 대한 죄책감과 분노를 함께 갖고 있었고 끝까지 자신을 보살피는 가족에 대한 고마움과 미안함을 표출했다. 또한, 선고받은 형량에 불만을 표시했고 전자발찌와 신상정보 공개는 가해자들에 대한 인격권 침해라는 인식을 공유하고 있었다. 특히 기소하고 판결을 내리는 과정에 개입된 경찰, 검사, 판사에 대한 강한 반감을 표출했고 범죄 사실에 대해 직면하기를 거부하는 모습을 보였다. 출소한 이후 전자발찌를 착용하고 신상이 공개될 것에 대한 두려움과 미래에 대한 불안이 있었다. 한편, 이러한 엄벌주의적 정책이 성범죄를 낮출 수 있다는 점에 대해서는 회의적인 시각을 갖고 있었다. 이러한 연구결과를 토대로 성범죄자들에 대한 실천적, 정책적 제언을 하였다.

영문 초록

The purpose of this study is to investigate the process of recognition among sex offenders, provide an effective treatment program, and establish practical fundamental data to reduce recidivism. The analysis of these categories showed that most of the sex offenders experienced family disorganization in the early stage of their growth and suffered from persecution complex. While in prison, the participants wanted to be given a treatment programme to control their sexual violence impulse. They felt angry as well as guilty about the victim and expressed gratitude and regret for their family taking care of them all the time. In addition, they complained of their sentence and shared the idea that the electronic anklet and revelation of personal information might impinge upon their personal rights. In particular, they showed strong antipathy to the police, the prosecution, and the judiciary that intervened in the process of prosecution and judgment and refused to face the actual offense. They were afraid of wearing the electronic anklet and having their personal information revealed after leaving prison and felt anxious about their future. They were skeptical of the idea that such a policy based on martinetism could reduce sex offenses. On the basis of these results, practical and strategic suggestions were made for sex offenders.
