영문 초록

After the Special Domestic Violence Act was enacted in 1997, the police officer’s concern for domestic violence has been gradually increasing than ever before. Nevertheless, many victims are not dissatisfied with the police activity yet, and complaining about poor treatment which is related with securing victims’ personal safety. The police officers’ negligence about victims’ protection, when victims is intimidated and being faced on the offenders’ attack, usually brings about their distrust against the police. The typical negligent attitudes of the police are presented as following : the police officers often make mistakes to judge the seriousness of a threat and make a response to the ongoing crisis too slowly ; police officers lack education and training which enable them to deal with the domestic violence properly and efficiently. As a result of that, many victims have been easily attacked and revictimized by offenders. Therefore, it is very crucial how the police investigators should assess the risk against victims’ personal safety, and how or when to intervene in that situation. For this purpose, the risk assessment checklist for police investigators was developed and has been strongly recommended for them to use it on this paper. However, it would not be useful if the police investigator would not be trained to make full use of the risk assessment checklist. In addition to that, even if offenders, who are under the control of the Temporary Court Order, are likely to retaliate the victims because there is no more determent which is able to prohibit offenders from doing harm against the victims. In other words, there are no measures to handle the offender to prevent his attack on the basis of the present the Special Domestic Violence Act. So, it is necessary for the Special Domestic Violence Act to be revised. Finally, the police should be empowered to have authority for issuing a temporary police order for securing victims’ personal safety on the hot spot so that it could keep the victims away from any offenders’ attack successfully.
