집합건물의 공용부분 변경에 관한 몇 가지 문제

국문 초록

본 논문은 집합건물에 있어서 특히 공용부분의 변경시에 발생하는 몇 개의 법제적 및 실무적인 쟁점들에 대해 고찰을 하고 있다. 공용부분에 대한 법리적 해석, 전유부분과 공용부분과의 경계, 공용 부분의 변경 및 처분에 대한 대법원의 판단, 2011년부터 진행되어온 집합건물법에 대한 개정작업에서 진행되었던 공용부분 결의율의 완화에 대한 논의, 변경에 대한 비교법적 고찰 등을 통해 우리법의 현재의 모습과 이상적인 개정법의 형태에 대해 연구를 진행하였다. 본 논문은 집합건물에서의 공용부분이라는 구성부분에 대해 횡적 방향으로의 연구를 전개하고 있다. 공용부분의 변경에 있어서 요구되는 구분소유자 및 의결권의 각 4분의 3 이상의 요건에 대한 적정성 등에 대한 고찰을 통해, 엄격한 결의요건을 배제하고 변경의 절차적 요건을 완화한 일본법 등에 대한 비교고찰을 통하여 우리 집합건물법에 대한 시사를 발견할 수 있었다. 집합건물법에 대한 해석 및 적용에 있어서 그 사정을 건물에 두는 것이 아니라 구분소유자의 소유권 및 사용권이라고 하는 권리에 초점을 맞추어 해석 및 적용을 하는 것이 바람직할 것인데, 현재의 우리 집합건물법의 태도와 실무의 동태 및 비교법적 고찰을 통해 적절한 입법을 모색하는 것으로 결론을 대신하였다.

영문 초록

This study seeks to examine several legislative and practical issues especially about change of common element in aggregate building. In details, this study discussed jurisprudential analysis of such common element, boundary between exclusive and common element within aggregate building, Supreme Court's judgment on change and disposition of such common element, and mitigation of determination rate about common element (as discussed in latest revision works for aggregate building laws from 2011 onward), and examined such change of common element from the perspective of comparative law, so that it could investigate current positions of South Korean relevant laws and any ideal form of revised laws. This study develops its focus of research laterally into common element, a component of aggregate building. It excluded any strict requirement of determination by examining appropriateness about unit owners and quorum requiring more than 3 of 4 voting rights in change of common element. And it made a comparative examination into Japanese laws and other foreign laws which focus on mitigation of procedural requirements for changing such common element, so that we could find any implication for South Korea's aggregate building laws. With regard to analysis and application of aggregate building laws, it would be advisable to focus on unit owner's ownership of building and right to use it, rather than focus on building itself. This study discussed current positions and practical behaviors of South Korean aggregate building laws and made a comparative statutory examination into those laws, so that it could explore proper legislations rather than come to any conclusion.
