영문 초록

本稿は韓国政府が現在実施している強制動員被害支援の意義及び現況を検討し、諸般の問題点を批判的に考察したうえで解決方案を模索した研究である。2000年代韓国政府が実施した日帝強制動員被害真相糾明は被害国が直接被害調査及び真相調査を行なった世界史的に類例がなかった事である。2008年から始まった強制動員被害支援は政府の調査内容をもとに支援が行われるシステムで、1975年の対日民間請求権補償と比べて補償対象及び補償規模が拡がったという評価を受けている。しかし国内強制動員被害者が支援対象から除かれている問題や遺族の範囲に関する問題、支援受付手続上の問題などが残っている。 政府は現在の｢被害支援｣が抱えている多くの問題点を是正して被害者と遺族に不利益がないようにしなければならない。国内強制動員被害者には国外動員被害者と衡平な支援が行われる必要があるし、遺族の範囲は国家予算が許される範囲で最大限広げながら、遺族たちの間に優劣などの不合理が生じることなく、法的安全性が損なわれないように規定を明文化して関連問題を解決しなければならない。 日帝殖民支配清算の一環である強制動員被害調査は政府次元の調査としては最後の機会になるかもしれない。強制動員被害調査は事案が古くて時間が 経つほど事実関係の立証が難しい。当事者と遺族は高齢で、一刻も早く実態 究明と被害補償が行なわれるべきである。後になって再び政府補償が充分でなかったという論難が生じないように、現在の国家財政能力範囲で最大限の被害救済が成されるべきである。被害者に対する救済が実現するまで長い時間がかかっただけに、これからも十分な調査過程を経て、もうこれ以上無念の被害者が生まれないように万全を期すことが韓国政府の課題である。 This study has examined the meaning and status of the support of damage caused by compulsory mobilization, which is currently being implemented by the Korean Government ; reviewed overall problems from a critical perspective ; and sought solutions for them. The Korean government’s verification of realities of the damage caused by compulsory mobilization of the Japanese imperialism, which was waged in the 2000s, is an unprecedented event seen from the point of world history because the nation suffering damage is directly investigating the scale of damage and realities of the historic events. The support of damage commenced in 2008 is structured upon the basis of providing relevant support to the victims in accordance with the results of government investigation, and is assessed to have enlarged number of victims and scale of compensation as compared to the compensation made by Korea’s civil claims against Japan in 1975. However, there are still lots of problems such as exclusion of domestic mobilization victims from the list of the supported victims, confining the category of bereaved families, streamlining the procedures of application and reception, and so forth. The government should overcome diverse problems that are inherent in the current ‘Support of the Damage’, and take measures so as not to attribute any disadvantage to the victims as well as bereaved families. The support for domestic mobilization victims should be fair and proportionate with that for overseas victims ; the category of the bereaved families should be enlarged to the maximum extent the government’s budget allows ; and the related problems should be solved by substantive enactment with a view to prevent occurrence of irrationality vis-a-vis the merits and demerits between and among the bereaved families, and of desecration of legal stability. The investigation of the damage can be the last chance as a government level investigation. As investigation drags and time passes by, verification of the relevance of facts will be difficult.
