包山楚司法簡硏究述評(1991ㆍ1~2011ㆍ1)

국문 초록

포산초간은 중국에서 출토된 가장 큰 규모의 전국 문서이며 1991년 공포되었다. 30년 동안 출토된 초간 중 유일하게 사법 문서를 위주로 한 간독이며 초의 사법을 연구하는데 가장 중요한 사료라고 할 수 있다. 포산초간은 사료의 공백을 메우는데 매우 중요하다. 이것이 공포된 이후 학계는 그 독특한 내용에 대해 관심을 가졌으며 전면적이고 심도깊은 연구를 해왔다. 주로 연구의 관심은 簡牘의 編聯이나 文字의 釋讀, 그리고 簡文의 內容에 관한 연구는 地理、 姓氏、 職官、 喪祭制度 등에 집중되었다. 그런데 그 핵심적인 내용인 사법 방면에 대해서는 비교적 그 성과가 뚜렷하지 않다. 그것은 연구의 난점 때문일 것이며 이로 인해 포산초간이 가지는 사법간으로서의 모습을 처음에는 제대로 보여주지 못한 것이다. 그러다가 20년 경과 시점부터 차츰 심도 깊은 연구가 포산초간의 사법간에 대해서 이루어지고 큰 진전을 이루기 시작하였다. 이에 포산초간의 사법간에 대한 연구에 대해 학술사적인 회고와 총결이 필요하게 된 것이다. 包山楚簡의 出士 觀況과 硏究階段、 司法簡의 硏究成果、 司法簡 중 主要 問題 등에 대해 살필 것이다. 또한 포산초간의 연구 의의와 이후의 연구 전망에 대해서도 논의할 것이다.

영문 초록

The famous BaoShan(包山) bamboo slip has been published in 1991, it was first unearthed in China as the size of the pre-qin(先秦) Period documents, and it is the only bamboo slips unearthed in the last three decades of judicial file-based slips. In the end, it is irreplaceable first-hand historical data to study the history of Justice about the state of Chu(楚). For the present-day people, if we give the situation of the lack of legal historical data history of the pre-qin(先秦) Period, BaoShan(包山) bamboo slip is even more important value in fill the information gap in the study area of the justice system of the state of Chu(楚). Since BaoShan bamboo slips released, its text and unique content to attract Chinese and foreign academics to carry out a comprehensive in-depth research, access to many research. If we review the research results about BaoShan(包山) bamboo slip, In basic research field, attentions of researchers including Slips bindings, Interpretation of the text, etc. In the field of the slips content research, they have focused on areas including geography, surname, Officials, funeral sacrifice system research, etc. However, In the BaoShan(包山) bamboo slip research field, academic achievement is relatively rare in the field of the state of Chu’s(楚國) judicial system according to BaoShan (包山)bamboo slip. This is because the judicial system is research challenge in the research field of BaoShan(包山) bamboo slip. This situation is not satisfactory to people, because we know that slips of judicial documents in BaoShan(包山) bamboo slips has the most important position. In order to change the unfavorable situation, and are conducive to future research about BaoShan(包山) bamboo slip, especially in the areas of research on judicial instruments Slips we need to review the history of academic research. As we know, there are scholars to write comments related to research of review the history of the study of the BaoShan(包山) bamboo slip has been published after the collation of the report announced a year later, but because the article was published earlier time ,it can only reflect BaoShan(包山) bamboo slip early years of preliminary research findings. After nearly 20 years past, Scholars’s research result are beyond the initial stage of the study in the quantity and quality, when many of the conclusions to be proved wrong, and has been fixed, especially in the field of the history of judicial on the state of Chu(楚). Obviously, the first paper has not as our reference. For above considers, in order to allow researchers in related fields to understand BaoShan(包山) bamboo slip research in the development of the past 20 years, and, more current and potential involvement of researchers also need such a new Review of academic history. Given the above considerations, we write this paper according to the progress of the last 20 years of research, our paper Include the following : in first, we describes overview of Research of the bamboo slips unearthed in Baoshan(包山) Jingsha(荊沙) City of Hubei(湖北) Province in China and its research stage. The second part, we mainly review the research achievements of Baoshan(包山) bamboo slip of Justice documents. And the third, we evaluation the study of main issues and the main problem in research studies of the Baoshan(包山) judicial bamboo slip. Finally, the paper explained the legal significance of historical research and future research prospects on Baoshan(包山) judicial bamboo slip and the judicial system of the state of chu(楚).
