국문 초록
각 국가들이 비만에 대해 정부적 차원의 관심을 기울이는 것은 비만이 질병 그리고 인간 삶의 문제와 직결되어 있기 때문이다. 미국의 질병대책 센터에 의하면 부적절한 식생활과 운동부족으로 인한 사망이 40만 명이며, 비만이 담배에 뒤이어 전체 사망 원인의 17%를 차지하고 있다고 한다. 비만에 의한 직ㆍ간접적인 사회적 손실은 1,170억 달러이며, 미국성인의 64%가 과체중이다.
과거에는 개인의 비만문제를 자기책임이라고 생각했다. 그러나 비만이 다른 질병 등과 연계되면서 이를 조장하는 기업이나 식품업계에 대해 무엇인가 조치를 취해야 한다는 문제제기가 있었다. 미국에서 비만책임과 관련한 집단소송이 제기되자 집단소송의 위협을 느낀 외식 기업들이 정책 변화를 시도하였다. 물론 비만 소송 때문만은 아니겠지만 패스트푸드업계가 건강음식으로 방향을 전환한 것은 의미가 크다.
본 연구에서는 비만의 원인과 책임을 패스트푸드라고 주장하는 비만소송(Pelman v. McDonald’s Corp.)을 검토하고 있다. 비만의 책임을 둘러싼 Pelman v. McDonald’s Corp.소송이 제기되자 미국에서는 국민들의 주요 관심사가 된바 있다. 그러나 집단소송에 의해 외식업계가 받을 타격을 우려한 미국하원은 비만을 이유로 한 식품 업체의 소송을 방지하기 위한 법안(The Personal Responsibility in Food Consumption Act: 일명 치즈버거 법안)을 통과시켰다.
본 연구에서는 비만의 원인과 패스트푸드의 책임을 둘러싼 비만소송에서 제기된 문제들을 검토하고 있다. 즉 비만의 원인과 외식산업의 책임, 유해한 재료와 제품설계, 과도한 양, 표시의무, 자기책임과 퍼터널리즘 등이 쟁점이 그것이다. 또한 비만소송 이후 외식산업과 비만의 책임을 둘러싼 입법의 동향과 업계의 동향 등에 대해 검토하였다. 이러한 연구검토 결과는 한국에서도 향후 제기될지 모를 비만소송에 주요한 시사점을 줄 것으로 기대한다. 비만소송에서 제기되고 있는 비만의 책임, 패스트푸드의 문제점, 외식산업과 국민의 건강에 대한 정부의 개입 한계 등은 한국에서도 문제가 될 여지가 있기 때문이다.
영문 초록
This paper is the study on the debate about the responsibility of obesity in the United States. This study examined precedent on the Pelman v. McDonald’s Corp., 237 F. Supp. 2d 512(2003) and Peman v. McDonald’s Corp., and 2005 WL 147142(2nd Cir. Jan. 25, 2005), etc.
The American obesity epidemic is no longer an emerging issue in news and politics. Although Americans have been gaining weight for decades, the latest movement against excessive weight-gain and obesity emerged in 2000 when the U.S. Department of Health reported that 64% of American adults were overweight, children and adolescents were overweight, and obesity caused approximately 400,000 deaths a year.
2004, Politicians opposing frivolous lawsuits against the manufacturers, distributors, and sellers of food, responded by passing “The Personal Responsibility in Food Consumption Act.” Dubbed the “Cheeseburger Bill” this law would block lawsuits from being filed against restaurants in federal or state courts. Opponents of litigation, governmental regulation, and proponents of personal responsibility continue to criticize this bill as an attempt to scapegoat fast food restaurants for people’s poor personal choices, and as an impractical method for combating obesity.
Pelman v. McDonald’s Corp., is the most well known attempt to hold fast food restaurants accountable for America’s weight problems. United States District Judge, an advocate of legalizing recreational drug use, and a firm believer of the right to self-determination, posed the question. The Court did not fully answer this question, and Judge dismissed the complaint with leave to amend. But the Second Circuit’s ruling is significant in two respects. First, the revival of obesity litigation by an appellate court likely will spur further litigation against other industry participants, including restaurant chains, soft drink producers, snack food makers, and others. Second, and equally important, the Second Circuit’s decision conflicts with decisions of numerous other courts that have held Rule 9(b)’s heightened pleading standard to apply to statutory consumer fraud claims.
The health risks faced by the American children far outweigh the needs of its mass marketers. Congress should ban all advertisements aimed at children that promote foods high in fat and sugar. Major policy changes, and political and social vigilance, are material to empowering the public, politicians, and judges, to prevent a complete inundation of fast food commercial marketing. Anti-fast food advocates have only just begun and a long road lay ahead, especially in light of the political resistance to regulation and litigation.
