국문 초록

본 연구의 목적은 로테르담규칙상 전자운송문서의 시사점에 관한 것이다. Hague-Visby 규칙상 송하인의 요청에 따라 선하증권을 발행하는 것은 운송인의 의무로 되어 있지만, Rotterdam 규칙상 송하인은 어떤 형식의 요청도 필요 없이 운송서류에 대하여 권리를 가진다는 것이 양자 간의 현저한 차이점이다. Rotterdam 규칙에서는 송하인의 선택에 의하여, (a) 비유통성 운송서류 또는 비유통성 전자운송기록, (b) 적정한 유통성 운송서류 중에서 교부를 청구할 수 있다. 그러나 송하인과 운송인이 유통성 운송서류 또는 유통성 전자운송기록을 사용하지 않을 것을 합의하거나, 거래관습, 관행 또는 실무상 그것을 사용하지 않을 경우에는 제외된다. 본 연구에서는 이 규칙상의 전자운송기록조항을 중심으로 분석한 후 그 시사점을 도출하고 있다.

영문 초록

The purpose of this study aims to the implications of electronic transport document on the Rotterdam Rules. The most notable difference follows the fact that under the Hague-Visby Rules regime the demand of the shipper triggers the duty of the carrier to issue a bill of lading, while under the Rotterdam Rules the shipper is entitled to a transport document with no need for any formal request. Rotterdam Rules gives the shipper the option to demand: (a) a non-negotiable transport document or a non-negotiable electronic transport record; or (b) a negotiable one in an appropriate form. However, the option to obtain a negotiable document or record is not available to the shipper in case it had agreed with the carrier not to use documents or records in negotiable form or-once again-in case it is the custom, usage or practice of the trade not to use one.
