국문 초록

인터넷 발달과 더불어 기존의 상거래 형태가 국제적인 거래로 확대되면서 새로운 형태의 기업들이 출현하였다. 이들 기업들은 일치감치 온라인 공간의 특수성을 파악하여 온라인을 통한 거래를 활성화시켰다. 하지만 인터넷 경제의 발전으로 인하여 국경이 무색해짐에 따라 국제적인 송사 또한 증가하고 있다. 이러한 비경제적인 상황을 극복하기 위하여 생겨난 것이 바로 온라인분쟁해결이다. 특히, 무역환경은 과거와 비교하여 거래과정과 품목이 매우 다양해지고 있고, 거래규모와 건수도 급증하고 있다. 이러한 현상은 무역자유화로 인하여 더욱 증가할 것으로 판단된다. 따라서 무역분쟁을 어떻게 대처하는가가 무역업체들의 거래관계에 큰 영향을 미칠 것이기 때문에 유연한 분쟁해결수단의 도입이 더욱 요구되고 있다. 따라서 본 논문은 무역기반 ODR의 활성화에 관하여 연구를 하고자 한다.

영문 초록

Due to development of internet, companies which have new business types have been appeared while existing business transaction trends are expanding to international transaction. These companies figured out the distinct characteristics of online space rather early to vitalize the transaction via online. However, because border is getting noting due to development of internet economy, international lawsuit is also increased. To overcome this kind of uneconomical situation, online dispute settlement has been created. Especially, transaction process and items of trading environment are diversifying compared to the past, and trading scale and numbers are also increased. These phenomena will be increased more due to liberalization of commerce. Thus, because how responses to the trading dispute will affect on transactions between trading companies, demands on introduction of flexible dispute solution are required. Therefore, the purpose of this study is on the activation of trade-based ODR focusing on trading disputes.
