성과 결혼의 윤리적 정당화

국문 초록

성은 동물적 존재로서의 인간의 본능에 속하는 것이지만, 다른 한편 인간은 어떤 이유와 방식으로 성 행위를 하고 성적 결합을 지속할 것인지 선택할 수 있다. 이런 측면에서 성과 결혼을 규범적으로 정당화하려는 다양한 시도가 있었다. 성과 결혼을 순전히 개인의 선택과 계약을 통해 정당화하려는 자유주의적 해석은 상대의 인격을 성적 욕구 충족의 수단으로 삼을 밖에 없다는 점에서, 인간의 존엄성을 훼손한다는 한계를 갖는다. 이 문제와 관련하여 칸트는 인간의 존엄성의 훼손할 수밖에 없는 성 행위가 윤리적으로 허용될 수 있는 가능성을 결혼을 통한 두 인격의 의지의 통일에서 찾는다. 칸트는 성이 본질적으로 비윤리적이며 성의 윤리적 허용가능성을 결혼에서 찾는다는 점에서 보수적인 성 윤리와 유사하지만, 성의 비윤리성을 인격의 대상화에서 찾고, 결혼의 정당성을 두 인격 사이의 성의 교환을 위한 계약에서 찾았다는 점에서는 자유주의적 계약론과 유사하다. 하지만 칸트가 결혼 계약의 근거를 두 인격의 동의에만 의존하지 않고, 자연법칙에 따른 의지의 통일에서 찾았다는 점에서는 기존의 입장과 차별된다. 인간의 존엄성을 이념으로 하는 민주주의의 원칙들을 받아들이면서, 성과 결혼을 윤리적으로 정당화하려고 한다면, 칸트의 입장에 주목하지 않을 수 없다. 본 논문은 성과 결혼을 정당화하는 칸트의 논의를 해명하면서, 칸트의 입장을 자유주의적으로 해석하는 매프스(Mappes)와 덕 윤리의 관점에서 받아들이는 너스바움(Nussbaum)에 대한 검토를 통해 그들의 오해와 한계를 밝히려고 한다.

영문 초록

Sex and marriage is route into classical philosophical issues such as the good and the scope of individual choice, as well as itself raising distinctive moral questions. Moral philosophers have debated whether marriage has a special moral status and relation to the human good. The ancient and Christian philosophers claimed that sex and marriage is permissible in purpose of reproduction. But nowadays, contractualists claim that sexual activity and marriage is justified on condition of consent and reciprocity. But in sexual activity, individuals involved in it reduce themselves mutually to mere things. Libertarianist like Mappes claims this mutual 'reducing mere thing' is morally acceptable only if it happen 'mutally'. Consent and reciprocity satisfy the conditions to make sexual activity morally acceptable. However, person's providing free and informed consent is, in general for Kant, necessary but not sufficient or satisfying the Second Formulation of the Categorical Imperative. In addition, treating someone as a person, for Kant, includes taking on the other's end as if they were one's own ends. Therefore, Kant claims no one can have a right to another's "sexual attribute" without having a right to the whole person. Kant also claims that there is only one sort of enforceable contract related to sexuality and he calls this sort of contract a 'marriage.' In this paper, Thomas Mappes and Martha Nussbaum's theory of sexual morality will be examined to see differences between their position and Kant's.
