국문 초록

본 연구는 공동주택재건축사업의 활성화를 위해 신탁방식의 적용가능성을 검토한 것이다. 신탁법전 부개정안에 기초하여 프라임(Prime) 신탁방식과 서브프라임(Sub-Prime) 신탁방식, 법률적 가능성과 기능적 가능성으로 구분하여 검토하였다. 법률적 검토결과 프라임 신탁방식과 서브프라임 신탁방식 모두 재건축사업에 적용이 가능함을 확인하였다. 기능적 검토결과 ⅰ)수탁자의 사채(社債)발행, 수익권의 질권설정, 수익증권의 유동화로 사업자금 조달이 가능하고, ⅱ) 프라임 신탁방식의 경우 조합의 부조리가 발생할 수 없으며, 매도청구소송기간의 단축 및 사업기간 단축의 효과가 예상된다. ⅲ) 서브프라임 신탁방식의 경우 시행자의 지위가 수탁자에게 이전되어 조합에서 발생하는 부조리의 상당부분이 줄어들 것으로 예상된다. 이러한 결과에 근거하여 신탁방식은 재건축사업에 적용할 수 있다고 판단한다.

영문 초록

In this study, we investigate whether a trust-method is applicable to the multi-family reconstruction project. On the basis of the Entirely Revised Bill of the Trust Act, we examine the trust-methods using the classification in terms of the Prime, Sub-Prime, legal and functional possibility. We find both Prime and Sub-Prime trust-methods are applicable to the multi-family reconstruction projects a result of the legal investigation. In terms of the functional investigation, using the trust-methods may lead to several advantages : i) It supplies the capital for a business by the issue of a bond for the Trustee, the establishment of a pledge right for the Beneficiary right, and the securitization of Beneficiary certificate. ii) The Prime trust-method prohibits the irregularity of the Union and reduces the periods of a claim for the property sales and projects. iii) The Sub-Prime trust-method may lead to decrease the irregularity of the Union by transferring the executor’s position to the Trustee. Thus, we conclude that a trust-method is applicable to the multi-family reconstruction.
