국문 초록

중국 형벌과 법률의 진화와 개념 이해에 대한 상대 형벌의 연구는 중요한 의의를 가진다. 20세기이래, 중국의 학자들은 상대의 형벌에 대한 출토 문물과 전해져온 문헌을 이용하여 비교적 전면적인 연구를 진행하였다. 1899년, 王懿榮이 갑골문자를 발견하였다. 뒤이어, 중국학자들은 갑골문자에 대한 정리, 고증 중에 있으며, 조금씩 갑골문자에 있던 상대 형벌연구가 이루어졌다. 그리고 점차로 갑골문자에 있던 오형과 기타 몇 개의 형벌을 고증하기 시작하였다. 2006년 출판된 '夏商西周法制史'는 갑골문자 내의 형벌 비교적 전면적이고 체계적으로 논술하였다. 20세기가 되었지만, 상대 형벌연구의 중심은 갑골문자의 오형이었다. 그러나 중국 학자들은 전해지는 문헌의 분산된 기 록과 후세의 “注疏”를 이용하여 상대 형벌에 대한 의의가 있는 연구를 진행하였다. 전체적으로 보면, 중국 학자들의 연구는 기초 상의 두개의 문제 상에 집중한다. 그 첫 번째는, 사료는 신용할 수 있는가 없는가이다. 많은 학자들은 사료의 진위와 성질에 대해서 의문을 제기한다. 그 두 번째는, 상대 형벌의 평가에 대한 것이다. 통상적으로 상대 형벌은 엄격하고 임의적이라고 생각한다. 하지만, 학자들은 史籍의 기록을 이용하여, 상대 형벌 비잔혹함을 제기한다. 혹자는 상대 초기에는, 형벌이 엄격하지 않았는데, 다만 후에 엄격하게 변했다고 한다. 지금 있는 상대 형벌 연구는 이미 많은 학술성과를 얻었지만, 몇 가 지 문제가 존재한다. 주요한 문제는 두 가지로 : 첫째, 지금 있는 사료를 어떻게 이해해야 하는 가이다. 자주 학자들은 상대 형벌의 연구자료가 매우 적다고 지적한다. 하지만 현존하는 연구를 살펴본다면, 나는(필자는), 상대 형벌 연구의 주요한 어려움은, 자료가 매우 적다고 말하는 것보다, 현존하는 사료에 대한 진행을 확실하게 이해하고 있는지 말하는 것이 더 낫다. 특히 명확하지 않은 형벌이 포함된 사료 여부와 어떠한 형태를 거쳐 형벌의 의의가 시작되었는지의 표시하면, 사료의 핵심문제를 처리할 수 있다. 둘째, 어떻게 상대 형벌을 이해하는 가이다. 이 임무는 반드시 많은 학과의 개입과 상대사의 충분한 瞭解와 이해에 의존해야한다. 필자가 볼 때, 이러한 하나의 과정은 또 상술한 사료의 처리에 대하여 같은 곳에서 엇갈린다. 그러므로, 확장 상대 형벌 연구의 방법과 시야를 확장하는 것은 상대 형벌 연구의 주요한 수단이다.

영문 초록

This paper reviews the research history about the Penalty System in Shang Dynasty done by Chinese scholars from the beginning of the 20th Century. The researches over the Penalty System in Shang Dynasty have achieved agreat development in the past century. In 1899 the discovery of Oracle- Bone Inscriptions providing a new evidence for that research had a significant impact on the studies of Shang's Punishments. As the research on Oracle- Bone Inscriptions going, the clues of the Penalty System in Shang Dynasty come to be realized. The article YanQiZhiTan written by YeYusen in 1924, referred to several types of penalties. In 1961 ZhaoPeixin wrote an article Five Penalties in Oracle-Bone Inscriptions, which is widely quoted. In that article, he pointed out that Oracle-Bone Inscriptions provided evidence of the existence of five penalties in Shang dynasty. In addition, some other Chinese scholars argued that according to Oracle-Bone Inscriptions other punishments such as Tu, Chi, Liu also existed in Shang dynasty. Legal Systems of Xia, Shang and Western Zhou, a book written by HuLiuyuan and FengZhuohui, through a systematic study of Shang's puninshments offered wide influence. Although Five Punishments in Oracle-Bone Inscriptions have been the core topic of studies of the Penalty System in Shang Dynasty in the 20th Century, Chinese scholars also have done many other valuable researches on Penalty System in Shang Dynasty based on history documents written by past generations. Generally most of their studies focus on two questions: first, the credibility of historical documents. Weather the historical documents are authentic or not, are the first important question which should be answered before the studies over Penalty System in Shang Dynasty. Second, the assessment of those punishments in Shang Dynasty. It is generally agreed that Shang's punishments are cruel and reckless. There, however, are still some disagreements. Although the studies of Shang's Punishments have made progress since the 20th Century there are still two issues needed to be put down: First, the lack of true comprehensive reading rather than that of data is the main obstacle for the research on Punishments of Shang Dynasty. Second, further comprehensive understanding is the main task of the future studies of Penalty System in Shang Dynasty. An approach based on multiple disciplines and fully understanding of the history of Shang dynasty are both helpful to improve this research.
