국문 초록

본고는 왜인관련 조선인 범죄유형과 그 처벌실태를 왜구침탈을 막지 못한 조선관리 처벌건과 밀무역사범 그리고 허위보고로 나누어 다루고 있다. 왜구침략을 막지 못한 조선관리 처벌부분에서는 조선초 왜구 침략행위를 날짜별로 정리해보았고, 그 가운데 벌어진 관리들의 처벌실태를 통해 그 상관관계를 다루어 보았다. 조선초 왜와 관련된 관리들의 처벌실태를 살펴볼 때 법 규정보다 엄한 형벌이 부과되고 있음이 밝혀졌다. 법정 최고형인 참형을 당한 경우가 무려 25%에 달했고, 장형들 중 장 100 이상형이 50%를 넘고 있었다. 밀무역 사범 사례에서는 전국의 화폐 가치와 가격동향에 따라 경제적 이익이 많이 남는 쪽으로 물품이 이동하고 있으며, 이러한 형태는 상인들에 의해서 주도적으로 행해졌음을 알 수 있다. 한편 왜구침략을 용인한데 따른 지나친 문책은 왜구를 잡았다는 허위 보고를 통해 승진과 포상의 기회로 삼으려는 역작용을 불러왔다. 출입금지 구역에 출몰한 왜인들에 대해 진위를 파악하지도 않고 죽였고, 공을 앞세운 나머지 있지도 않은 일을 허위보고하는 사례까지 생겨났다.

영문 초록

This paper deals with Korean crimes and punishment related to Japanese into three patterns that punished Joseon’s government officers who failed to repeal Japanese pirate’s invasion; smugglers; and false reporters. Related to the punishment of the officers who failed to repeal Japanese invasion, this paper arranged the invasion of Japanese pirate chronologically. Examination on the punishment for the officers’ crimes related to Japanese showed that the heavier degrees of punishment were laid on the related crimes. For instance, beheading, which was the heaviest punishment, took 25% of the total number of punishment; the punishment of more than 100 strokes occupied more than 50% of the total number of punishment with strokes. Smuggling was committed mostly by merchants and goods for smuggling were moving to the places where the margin of economic gain became larger according to the value of money and the fluctuation of prices. While, over investigation and punishment brought about a negative result that invites the false report to capture the Japanese pirate which will give an oppertunity for the advancement in rank and awards. There were incidents to kill Japanese who appeared at the district prohibited to enter without investigating on the fact. Otherwise, some one reported falsely to show his valor and achieve its gain.
