국문 초록

본고는 조선초 세종시기에 행해진 대명률운용실태에 대해 동일한 사례와 차별적인 시행례를 중심으로 살펴보았다. 밝혀진 내용을 정리 요약하면 다음과 같다.동일한 운용사례와 차별적 시행 예에서 공통으로 다루어지고 있는 부분은 신분 차별적 요소가 법 운용시 보다 적극적으로 적용되고 있다는 점이다. 良賤相婚 소생에 대해 從夫爲良法을 따르지 않고 從母爲賤法을 수용한 것은 신분 차별적 요소를 보다 더 강화한 사례라 할 수 있다. 그리고 부모와 남편의 喪을 숨긴 자와 부모의 봉양에 闕失이 있는 자에 대해 대명률보다 처벌을 강화하고 있는 사례 등은 조선이 중국 법을 수용하였으나 반 유교적 행위에 대해서는 보다 더 엄한 형벌을 적용하였음을 알 수 있다.절도범 처벌실태의 변천과정에서는 세종이 지니고 있는 법의식의 일단을 살펴볼 수 있었다. 인정을 베풀어 최대한 관용을 베풀고자 하는 군주의 심정과 절도범 창궐을 막아 민생을 안정 시켜야 하는 현실적 고뇌가 결국 현실을 외면 할 수 없는 방향으로 변천되고 있음을 알 수 있다. 한편 公私범죄를 저지른 관리에 대해 형벌을 엄히 적용한 점은 왕권 강화의 측면뿐만 아니라 백성에 대한 사랑의 일면이 아니었을까 생각된다.

영문 초록

This thesis deals with the reception of Daemyungyool (大明律:basic code of law of Ming dynasty) and the transition of the reception in Chosun dynasty. The code was interpreted word-for-word because it could not be easily understood without knowledge of Chinese legal terminology even for the learned. This research offers an explanation about the process of interpretation. It also refers to Gyunggukdaejeon (經國大典: code of law of Chosun dynasty) in terms of supplementary and corrective roles to insufficiency and problems of enforcement of the interpreted version of the imported code. The idea of etiquette of Confucianism became the main part of law. There was grade of blood relationship in the family and that of status in the society. The person who violated law in order to show his/her filial piety would be dealt with leniently; while the unfilial criminal would be punished severely. All these show that the ruler on that time tried to utilize the idea of ethics of Confucianism to govern people. In order to remedy the cruelty of law; for the elders, children, women, and disabled people, parading “external Confucianism and internal law”, a policy of benevolent was applied the patriarch (of a family or tribe) had lots of rights, while as to the inferiors and children, their duties were stressed but their rights were ignored. There was a phenomenon of “respected official but inferior common people” in carrying out law. When “the Law of Ming Dynasty” was spread to Chosun, there was a huge shaking not only in religion and custom, but also in ideology etc. This paper places in depth emphasis on Chosun's own social structure, value system and practices by dealing with the articles of Gyunggukdaejeon (經國大典: code of law of Chosun dynasty) that were locally applied or newly created to the society of Chosun. This thesis contributes to examine social aspects of early Chosun dynasty to the extent offering inherent phenomena to the society after inventing new norms of rule through reception of Chinese law culture.
