주요국의 아동 체벌 금지 입법 사례와 시사점

국문 초록

본 연구는 각국의 아동 체벌 금지 입법 사례를 통해 그 시사점을 고찰해 보고 자 하였다. 먼저 아동 체벌 금지의 기초로서 세계적인 아동 체벌 금지 입법 현황 과 유엔의 아동권리협약을 살펴보고, 세 개의 권역으로 나누어 유럽지역은 스웨 덴을 중심으로, 아메리카 지역은 코스타리카를 중심으로, 아시아․태평양 지역은 뉴질랜드를 중심으로 살펴보았다. 스웨덴은 세계 최초로 아동 체벌 금지를 입법 화한 국가이다. 그러나 스웨덴 내부에서도 아동 체벌 금지를 법으로 규정하는 것 은 아동 훈육에 어려움을 초래하는 문제가 제기되고 있다. 코스타리카는 비교적 가장 최근에 아동 체벌 금지를 입법화한 국가이다. Paniamor라는 아동인권조직 이 사회적 관념에 도전하지 않고, 교육과 홍보를 통해 타당성을 주장한 것이 입 법과정에 주요하였다. 뉴질랜드는 영어사용권 국가에서 처음으로 아동 체벌 금지 가 입법화 되었다. 정치적인 공조와 꾸준한 캠페인은 사회적 인식변화를 가져왔 으며, 다문화사회인 점을 고려하여 다양한 자료를 제공하고 홍보하였다. 한국의 상황에 비추어 볼 때, 아동 체벌에 대한 내용은 보다 명료화하고 긍정적 훈육과 현실에서의 문제 대처를 위해 각계의 공조가 요구된다.2)

영문 초록

The purpose of this study is to explore children corporal punishment abolition legislation in major countries. So, first, we have reviewed the trends international level of children corporal punishment abolition legislation and UN Convention of Children Rights. We have chosen three countries cases. These are Sweden in Europe, Costa Rica in Latin America, New Zealand in Asia and Pacific. First, Sweden is the first country which have enacted children corporal punishment abolition. However, in Sweden, there are many difficulties of children discipline without corporal punishment. We can evaluate highly Sweden's alternative of positive discipline. Second, Costa Rica is the county which have enacted children corporal punishment abolition legislation in 2008. Costa Rica is small county. So organizations of children rights are easily to meet and access politicians. Paniamor is the most influencing organization of children corporal punishment abolition legislation. One of their Strategies is contextual approach. This is very practical and effective for public. Third, New Zealand is the first English speaking country which children corporal punishment abolition legislation. In New Zealand, any private person and politician can draft and submiss the legislation. So, Sue Brdaford have contributed to enact children corporal punishment abolition legalization. In this sense, implications regarding children corporal punishment in South Korea suggests that present act for children and education must be revised in detail and clear. We can consider reasonable helo from law and institutions.
