공유저작물의 상표권 주장에 관한 고찰

국문 초록

이 연구는 공유저작물에 대한 상표권을 주장함으로써 출판계에 논란을 불러일으킨 사례를 중심으로 “산업재산권으로서의 상표권과 문화성이 강한 저작권의 차별적 특성을 중심으로, 두 가지 권리가 충돌하였을 때 그 판단기준은 무엇인지” 살피는 데 목적을 두고 진행되었다. 그리고 이러한 연구목적을 달성하기 위해 설정한 연구문제에 대하여 다음과 같은 결론에 이를 수 있었다. 첫째, 저작재산권이 소멸된 저작물로서의 삽화와 제호를 상표로 인정할 수 있는가? 도서의 제목은 그 책의 내용을 표시할 뿐 출판사 등 그 출처를 표시하는 것은 아니어서 원칙적으로 그 상품을 다른 사람의 상품과 식별되도록 하기 위하여 사용하는 표장이 아니므로, 책의 제목으로 사용된 표장에 대하여는 그 표장과 동일 또는 유사한 등록상표의 상표권의 효력이 미치지 않는다는 점을 확인할 수 있었다. 특히 저작재산권이 소멸되어 공유의 상태에 있는 저작물에 대하여 새로운 권리로서의 상표권을 부여하는 것은 타당하지 않다는 결론을 얻을 수 있었다. 둘째, 저작권과 상표권이 충돌하는 경우 어떤 것이 우선하며, 그 판단기준은 무엇인가? 사례를 통하여 살핀 결과 도서
어린왕자의 상표권을 주장하는 쪽에서는 “스토리를 문제 삼는 것이 아니라 상표로 등록된 이미지를 도용하거나 모방했을 경우 법적 조치를 하겠다는 것”임을 주장하면서 “
어린왕자의 상표권은 보호받는 것이 당연하다”고 한다. 그러나 연구 결과 상표권 침해는 상표로 사용하였을 경우에만 해당하며 상표로 등록된 그림이라도 특정상품과 구별하기 위한 의도가 아니라면 도서로서의
어린왕자에 수록된 경우에는 상표권 침해로 보기 어렵다는 결론을 얻었다. 나아가 “책에 쓰인 해당 그림과 글자는 상표가 아니라 콘텐츠의 일부인 저작물”이며 따라서 도서
어린왕자에 대한 상표권 주장은 곧 ‘상표권의 남용’에 해당하는 것임을 확인할 수 있었다.

영문 초록

Based on actual cases of claims for trademark right of works in public domain, the purpose of this study was to primarily focus upon differentiated characteristics of trademark right (as an industrial property) and copyright (with strong cultural nature), and find out “what could be the judgment criteria for potential conflicts of those two rights.” And follow- up discussions starting from questions set to achieve the above goals hereof could come to the following conclusions: First, is it possible to accept illustration and title - works without validity of copyright and property - as a part of trademark? The title of book indicates its content, but doesn't show any source including publisher. Besides, it is basically not a binding used to discriminate one product from the other. So it could be here found that the binding used for title of a book has no validity of trademark right vested in same or similar registered trademark. Particularly, it was concluded that it would be inappropriate to vest trademark right as a new right to any work in public domain without validity of copyright and property. Secondly, if copyright comes into conflict with trademark right, which one may precede the other? And what are the judgment criteria for this question? As examined with actual cases, a party claiming for trademark right of a book titled ‘the Little Prince’ holds that “they will take reasonable legal actions against plagiarism of certain images as registered trademark, not bring the story of book into question,” and assumes that “their right to trademark of ‘the Little Prince’ must be protected from any unauthorized use.” However, this study could come to a conclusion that only the unauthorized use of a title for the purpose of trademark is construed as the violation of trademark right, and even a certain illustration registered as trademark can be hardly construed as violation of trademark right when it is contained in a book titled ‘the Little Prince’, unless the user has no intention to discriminate it from other certain products. Furthermore, it was concluded that “relevant illustrations and letters contained in book are not trademarks but (copyrighted) works as a part of content,” so the claims for trademark right of a book titled ‘the Little Prince’ are about “misappropriation of trademark right.”
