국문 초록

그동안 교정현장에서는 전통적으로 행해지던 교정기관의 재사회화라는 기능에 대한 한계를 느끼면서 국가의 책임하에 운영되던 교정처우 방식에 대한 변화의 필요성이 대두되고 있다. 이러한 변화는 교정분야의 민영화라는 흐름 속에 새로운 교정분야의 현상으로 창출되고 있다. 선진국의 교정역사를 살펴보면 민간부문에 의한 교정의 참여는 오랜 역사를 가지고 경제성과 효율성을 그리고 다양한 프로그램의 제공으로 점차 그 효과성이 입증되어 오고 있다. 이에 우리나라도 근대 전통적인 정부 주도의 업무들을 민영화에 대한 구체적인 운영 작업에 들어가고 있는 실정이다. 민간에 의해 운영되는 민간교도소의 설치는 우선적으로 수용공간의 확보, 과밀 수용의 문제와 더불어 국가의 형집행업무의 효율성 제고에 크게 이바지할 것으로 사료된다. 따라서 민영교도소에 대한 이론적 배경과 전반적인 사항에 대해 알아봄으로써, 향후 우리나라에서의 민영교도소 운영의 실효성을 기대해 보는 바이다.

영문 초록

So far a limit of resocialization function of correctional institution which has traditionally been performed was realized, therefore necessity of changing the way of correctional treatment operated under responsibility of government is being raised. These changes are creating new phenomena of correction service field within the trend of privatization of correction service field. In the histories of correction service in advanced counties, participation of private sectors in correction service and its effectiveness has been gradually proved through economical efficiency, efficiency and providing various programs for long history. Hence South Korea is also launching concrete operation for privatization of traditional tasks which have been leaded by government. First of all, establishment of private prison operated by private corporation would considerably contribute to promoting efficiency of execution service performed by government with securing space for imprisonment and solving overcrowding in prison. Thus, by examining theoretical background and general matters of private prison, I'd expect that the effectiveness of operating private prison in South Korea hereafter.
