국문 초록

이 연구는 영국보호관찰서비스의 역사적 고찰 그리고 20세기부터 부호관찰의 큰 3가지 주요 흐름이라 할 수 있는 관리(Management)와 위험요소(Risk), 어떤 일이 진정 보호관찰의 일인가?(What Works?)등에 대해서 치료(Care), 통체(Control), 관리(Management)라는 3가지 측면으로 나누어 고찰하고 이의 대한 교훈들을 통해 한국보호관찰서비스 개혁을 위한 발전적 방안을 제시하였다. 영국의 보호관찰서비스는 치료 및 갱생모델 그리고 통제모델사이에서 당시의 정치적상황과 맞물려 표류하여왔다. 1979년 영국보수당이 집권하면서 공공부문에서도 관리의 필요성이 강하고 요구되었으나, 이는 "효율적인 업무관리가 아닌 보호관찰서비스 업무로서 해야 할 일조차 효율성 측정이 불가능하다는 이유로 하지 않게 되었으며" 이는 결과적으로 1980년까지 영국형사사법기관의 효율성을 저하시키는 결과를 가져왔다. 그러나 1991년 형사사법의 재정 및 시행으로 인하여 "무엇이 진정 보호관찰의 일인가!"에 대한 이데올로기적 혁신운동이 일어나기 시작하였고 이는 범죄통제 및 관리 그리고 사회적 위험성의 예방을 목표로 하는 기존의 시설내구굼에서 지역사회 처벌 및 위험관리로의 인식전환을 의미하는, 환경을 이용한 보호관찰서비스(Environment Probation Service) 개념의 재정립을 가져오는 개기가 되었고 이는 지역사회교정 및 보호관찰서비스(Community Correction and Probation Service)의 초석이 되었다. 이 연구는 한국보호관찰서비스 개혁을 위해 두 가지 발전적 방안을 제안하였다. 첫째, 보호관찰 목표달성을 위한 "자원배분"과 관련된 여러 관리적 제반사항과 관련된 감독과정의 재구성 그리고 보호관찰관 역할의 와전한 재정립이다. 둘째, 대한민국국민을 위한 치료와 통제 그리고 위험관리 혹은 보호관찰의 효과성을 위한 "보호관찰업무혁신운동"의 필요성을 역설하였다.

영문 초록

This paper reviews the history of the probation service in UK and locates the three major 'drivers' of the probation service in the early twentieth century, namely, management, risk and the 'what works?' movement. Nest, the purpose of this paper to attempt a developmental plan for probation service's reform in South Korea. The probation service has traditionally provided a rehabilitative service for offenders based on a 'treatment' ideology drawn from a belief in scientific, causal explanations of crime. The application of management methods in the public sector is strongly associated with Conservative governments from 1979 onwards. It was not, however, until the late 1980s as a consequence of decreased confidence in the effectiveness of criminal justice agencies based on the premise that ' nothing works' that management practices were advocated as necessary for efficient and efficient and effective service provision. A pivotal point n probation service history can be seen in the two years after the implementation of the 1991 Criminal Justice Act when a 'just deserts' model was overturned and penal policy was governed by a 'prison works' ideology. During the 1990s the 'what works' movement emerged as a powerful, empirically-based argument that some work with offenders has a demonstrable effect on recidivism. It has become enmeshed in the agenda for a modernised national probation service, offering a basis for effective practice. The paper presents a developmental plan in two areas : (a) the probation officer role is entirely redefined, the process of supervision reconstituted as a set of managerial activities with 'others' delivering the service following 'resource allocation' (b) the 'what works' movement for the care or control, risk management of effectiveness - something for everyone in South Korea.
