국문 초록
현재 미국에서의 상업적 언론의 지위는 두 가지의 논점으로 압축하여 전개되고 있다. 첫째, 상업적 언론과 비상업적 언론의 구별여부와 그 기준이고 둘째, Central Hudson 사건에서 정립된 상업적 언론의 규제에 대한 심사기준의 해석이다.
미국연방대법원은 1976년의 Virginia Pharmacy사건에서 제시한 상업적 언론에 대한 헌법적 보호에 대하여 1980년 Central Hudson 사건을 통하여 구체적인 기준을 채택하였다. 확립된 비교형량기준은 첫째, 상업적 언론이 합법적 활동과 관련이 있으며 오해를 불러(misleading) 일으키지 않는 지 여부, 둘째, 상업적 언론 규제를 정당화하기 위하여 주장된 정부의 목적이 상당한 지(substantial)여부, 셋째, 그러한 규제가 정부의 목적을 직접적으로 향상시키는 지 여부, 넷째, 그러한 규제가 목적달성을 위하여 필요이상으로 광범위하지 않은 지 여부이다. Central hudson 판결은 오늘날까지 상업적 언론에 대하여 적용되어 왔으나 일관되게 적용되지는 않았다.
결국 논의는 세 번째와 네 번째로 귀일되는 데 상업적 언론에 대한 규제가 세번째 기준을 충족시키는 지 여부는 사건의 특수한 사실관계와 법원의 주관적 판단에 의존한다. 마찬가지로 규제와 목적이 네 번째 요건을 충족할 만큼 밀접하게
연계되어 있는 지의 여부는 더욱 어려운 판단일 수 있는 것이다. 결과적으로 Central Hudson사건의 기준은 사안을 오히려 복잡하게 만드는 맹점이 있음을 부인할 수 없으므로 재검토되어야 한다.
1990년대 이후 미국연방대법원은 44 Liquormart Inc. v. Rhode Island판결(1996)을 위시하여 Rubin v. Coors Brewing Co.(1995), Greater New Orleans Broadcasting Ass'n, Inc. v. U.S.(1999), Lorillard Tobacco Co. v. Reilly(2001), Thompson v. Western States Medical Center(2002), U.S. v. Michael Williams(2008)판결들을 통하여 상업적 언론에 대한 헌법적 보장의 정도를 강화하고 있다.
상업적 언론과 비상업적 언론을 구별한다는 것은 사실 많은 문제점을 가지고 있다. 상업적 언론에 대한 제한을 인정하는 그 저변에는 자유시장체제 자체에 대한 불신, 경제시장에서의 무제한적인 표현의 허용은 다른 비상업적 언론의 분야
보다 더 큰 위험을 발생 시킬 것이라는 단순한 두려움에 근거한다.불명확한 기준에 의한 상업적 언론과 비상업적 언론의 구별은 정부로 하여금 표현의 자유영역의 침범을 늘 가능하게 하는 위험성이 존재함을 인식해야 하는 것이다. 결과적으로 볼 때 상업적 언론에 대한 중간적 심사기준은 지양되어야 한다. 상업적 언론은 비상업적 언론과 마찬가지로 정부의 절실한 목적달성에 필요불가결한 경우 (necessary to a compelling state interest) 규제하는 엄격한 심사기준이 적용되는 것이 표현의 자유의 신장에 도움이 되고 대법원의 일관되고 명확한 입장확립에 따른 국민의 신뢰보호에 기여할 것이다.
영문 초록
The discussion on the constitutional status of commercial speech is focused on whether the distinction between commercial speech and noncommercial speech is necessary and whether the Central Hudson test is still useful to
review of the constitutionality of regulations on modern commercial speech.
The first case recognizing the First Amendment protection to commercial speech was born in Virginia State Board of Pharmacy v. Virginia Citizens Consumer Council, 1976.
According to the Court in Central Hudson Gas & Electric Corp. v. Public Service Commission, for commercial speech to come within the First Amendment protection, four-part test should be satisfied. First, at least, commercial speech at issue must concern lawful activity and not be misleading. Second, it must be determined whether the asserted governmental interest to be served by the restriction on commercial speech is substantial.
Third, it must be decided whether the regulation directly advances the governmental interest asserted, and finally, whether it is not more extensive than is necessary to serve that interest.
In my opinion, the distinction between commercial speech and noncommercial speech is confusing and ambiguous. As Justice Thomas clearly indicates, the commercial speech and non commercial speech dichotomy is useless and arbitrary. the distinction causes uncertainty of speech protection under the First Amendment. Regardless of commercial or non commercial speech, truthful speech which conveys accurate information must be fully protected. Furthermore, the commercial speech doctrine in itself that the Supreme Court has kept for a long time may violate the First Amendment when the doctrine limits commercial speech based on its contents.
In addition, under current social circumstances where informational value of speech is increasing, it is not persuasive any more that noncommercial speech is more highly valued than commercial speech.
The better way of to end this dipute is to give up the distinction perfectly. This would help to enhance the value of freedom of speech protected by the First Amendment.
Allowing full First Amendment protection to commercial speech does not curb the government from regulating false, misleading and illegal activities. Those kind of activities are excluded from the realm of speech described in First Amendment.
Therefore, commercial speech should be removed from the Central Hudson test and subject to liability under an actual malice standard or regulation under a standard of strict scrutiny. Only if the commercial speaker knew the content was false or made the statement with reckless disregard for the truth, he could be liable for making false or deceptive advertisements.
