지방자치제도의 현안에 대한 헌법정책적 제언

국문 초록

이 글을 본인 작성한 이유는 공법학의 논의가 헌법상의 지방자치는 제도라는 이름하에 너무 추상적으로 논의되는 경향이 있기에 좀 더 실효성있는 정책적인 대안을 제시하고 싶어서이다. 이전에 2004년 헌법학연구에서 지방분권과 지방자치라는 주제의 그을 작성한 이후 좀 더 본인의 생각을 발전시켜 현안중심으로 작성하였다. 제도의 성공은 그 법이외의 사회적 전반적인 전제조건들의 충분한 검토가 없는 한 단지 실패라는 시도로 역사에 각인될 수 있다. 헌법실현이라는 헌법상 요청과 앞으로 정부정책의 선봉에 헌법이 정책적으로 기여하며 헌법이 지배하는 사회를 꿈구며 이 글을 작성하여 보았다. 중앙집권이나 지방분권의 기준은 국민주권이라는 기준에 의하여 국민의 의해서, 국민을 위한 목적하에 엄격히 판단되어야 한다. 지방정부에 대한 관여도 그 중점이 통제보다는 오히려 지원에 있고, 비권력적 관계가 그 중심내용을 이루어야 한다. 하지만 현재의 행정구역개편이나 과거의 행정수도이전 등이 과연 이러한 동반자적 관계를 지향하고 있는지에 대해서는 의문이 든다. 지방분권과 지방자치는 현대와 같이 국가보다는 일반 국민들의 지식과 경험 등이 향상된 사회에서는 단지 선거용이나 국면전환용등의 일시적 선택사항이 아닌 민주주의국가를 선택한 나라들에게 있어서는 필수적인 사항이라고 보인다. 또한 이는 국가경쟁력이라는 효율성 및 존립과도 관계된다. 그런데 그 기본방향을 결코 중앙정부중심의 정책으로 해결하려는 것은 오히려 해가 될 수도 있으며 오히려 상향식인 국민의 의사에 기초한 개혁이어야 한다. 또한 정치적·경제적 분권과 사회적·문화적 분권에 중심을 두고 정책을 집행하는 것이 중요하지 중앙집권적 정책에 치우치면 그 결과는 자칫 사회적 반발을 일으켜 국가적 전력의 손실만 낭비하게 된다는 점을 주의할 필요가 있다. 최근 논의되고 있는 행정구역개편은 과거 논의되었던 행정도시이전과 더불어 자칫 중앙집권을 불러 올 수 있다는 점에서 과연 지방분권과 지방자치에 진정으로 도움이 되는지에 대해서 검토의 필요성이 있다는 문제의식에서 이 글을 작성하였다. 우리 나라의 지방자치가 제대로 자립잡지 못하는 데에는 기존의 논의가 주민의 대표제를 중심으로 한 개혁에 집중된 것은 아닌지 즉 풀뿌리민주주의를 위해 만든 지방자치에서 직접민주주의를 제대로 도입하지 않음으로서 발생한 문제인지에 대해서도 진지하게 검토할 필요가 있다. 경제적 측면에서 재정자립도가 충족되지 않는다면 실질적인 지방분권 및 지방자치는 요원하다고 할 수 있는데 과연 조세권을 중앙에서 지방으로 이전해 준다고 하여도 그 지방행정에 필요한 재원을 스스로 마련할 수 있는지에 대해서도 신중한 접근이 필요하다고 보이는데 따라서 기존의 재정자립도라는 기준이외에 실질적인 지방자립을 측정할 수 있는 기준에서 재구성하고자 하여 보았다. 지방자치는 자율성과 독립성에 바탕을 두어야 하나 그에 따르는 책임과 통제의 기능을 무시하여서는 아니되어야 한다는 관점에서 지방자치단체의 파산제도의 도입여부에 대해서도 검토하여 보았다. 모든 개혁에는 국민이 있고 국민을 위하여야 한다.

영문 초록

I came to write this thesis to propose the effective way because lately Korean assembly is under debate of the reform of administrative district, In 2004, I wrote thesis on Decentralization and Local Self-Government system and I came to write this thesis to develop the 2004 thesis. The important point of this national debate is, I think, which is better Local Government system or centralized authoritarian system. But many debates overlook this point. Local Government or decentralization can be greatly helpful for our democracy and our national competitiveness. The reason is that centralized authoritarian system, now, is not useful because citizen has more knowledge and experience than public service personnel in information-oriented society and centralized authoritarian government is remote from local government problem.. Instead, we must change the service of wide local government into service of basic local government properly, and then wide local government must exist for democracy and historical and cultural reasons, etc. To move korean capital and state organ into other local city is one of Local Government or decentralization. but I doubt if to move korean capital into other city is really efficient. Most of all, these reforms must be done under the consent and participation of local resident I prpose two financial reforms. First. I focus on the point that instead of central govermental reform, local goverment must play a major role in this reform. Specially I propose we must learn from chinese regional reform in the point of local financial independence which changes national tax into local tax on condition that this local financial independence measures can attract business and population Secondly To charge local government with responsibility , bankruptcy system of local government must be induced because in democratic nation, the subject which has freedom must take responsibility But our reforms now are focusing on local reform mainly in the point of wide local governmt ' abolition , reallocation of national affairs, central goverment leading reform, But local reform in the point of finacial regional independence seems to be neglected. This is a great mistake because without finacial regional independence and local goverment leading reform under the consent and participation of local resident, all these methods wll be unmeaninful. In this thesis, I describe the efficient method of political decentralization, and economic decentralization, respectively. Many national debates about local Government or decentralization is mainly discussed in political science, but, I think, constituitional law must be important standard of this national debate. So I expect our society will be governed by constituitional law.
